<br />Non-Professional Services Agreement between Last Edited 12/21/2022 City of San Leandro and PCFMA Exhibit A Page 2 of 4 <br />quality, or other factors, to not open the Market or to close the Market early on any Market Day. PCFMA will try to give City advance notice and in any case will notify City of any such decision. <br />1.7 Market Rules PCFMA maintains comprehensive market rules and regulations (“Market Rules”). The Market Rules cover, among other things: application, admission, and selling requirements for agricultural producer, non-agricultural producer, and artisan vendors; market management; stall space assignment; and signage, labeling, and sampling requirements. PCFMA will operate the Market in accordance with the Market Rules. It may amend the Market Rules at any time at its discretion. PCFMA will provide City with a copy of the most current Market Rules upon request. <br />1.8 Compliance with Law PCFMA in operating the Market will act with due care and in compliance with applicable law including, without limitation, provisions of the California Food and Agriculture Code governing certified farmers’ markets, local ordinances, and other applicable laws. <br />1.9 Permits and Licenses PCFMA will be solely responsible for obtaining and maintaining necessary permits and licenses relating to its activities in operating the Market. The Market Rules provide that individual Market Participants are responsible for obtaining needed permits and licenses for their own operations. 1.10 Access PCFMA will have access to the Site as shown in Exhibit D from 2 hours before the posted opening time of the Market until 1 hour after the posted closing time of the Market, each day the Market is scheduled to operate. 2. Site Responsibilities 2.1 Site Set-up and Take-down PCFMA will be solely responsible for the set-up and take-down of the Market on each Market Day. 2.2 Portable Bathroom Units In accordance to count and state Health codes, portable bathroom unit shall be place in a designated location. These units shall be dropped off and picked up on the same day as the market. 2.3 Noise PCFMA will make reasonable efforts to ensure that noise levels associated with entertainers and Market operators generally are appropriate and do not conflict with other events that may be occurring near the Site. 3. Marketing and Publicity 3.1 Market Name PCFMA will advertise and promote the Market using the market name Downtown San Leandro Farmers Market.
