<br />Amendment No. 3 to <br />Consulting Services Agreement between City of San Leandro and Project No. 2016.0320 <br />Harrison Engineering Inc., for Washington/Chapman RR Crossing Page 1 of 3 <br />AMENDMENT NO. 3 TO CONSULTING SERVICES AGREEMENT BETWEEN <br />THE CITY OF SAN LEANDRO AND <br />HARRISON ENGINEERING INC. <br />FOR <br />WASHINGTON/CHAPMAN RAILROAD GRADE CROSSING IMPROVEMENTS PROJECT <br /> <br />This Amendment No. 3 (“Amendment”) is made by and between the City of San Leandro (“City”) <br />and Harrison Engineering Inc. (“Consultant”) (together sometimes referred to as the “Parties”) as of <br />_____________, 2023, and amends that certain Consulting Services Agreement (“Agreement”) dated <br />December 7, 2017, between the Parties. <br /> <br />WHEREAS, City and Consultant have executed the Agreement, pursuant to which Consultant has <br />provided certain consulting services to City with regard to Washington/Chapman Railroad Grade Crossing <br />Improvements Project, and <br /> <br />WHEREAS, the Parties desire to amend the Agreement to extend the term. <br /> <br />NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby <br />acknowledged, the Parties hereby agree to amend the Agreement as follows: <br /> <br />1. Section 1.1 of the Agreement entitled “Term of Services” is hereby amended to extend the <br />term from December 31, 2022, to December 31, 2023; and <br /> <br />2. Section 2 of the Agreement entitled “Compensation” is hereby amended to pay Consultant a <br />sum not to exceed $72,400; and <br /> <br />3. Exhibit A of the Agreement entitled “Scope of Services” is hereby amended to include the <br />following added tasks: <br /> <br />i. Task 7B - Updating plans to include new work in the project area recently completed by an <br />adjacent development <br /> <br />ii. Task 9 - Provide construction staking to accommodate advanced railroad component <br />installations by Union Pacific <br /> <br />; and <br /> <br />4.
