IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2023-010 <br />RESOLUTION EXTENDING THE CONFIRMATION OF A PROCLAMATION OF LOCAL EMERGENCY AND <br />DECLARING ITS TERMINATION IN LINE WITH THE TERMINATION OF THE GOVERNOR'S STATE OF <br />EMERGENCY BY THE CITY'S DIRECTOR OF EMERGENCY SERVICES PURSUANT TO CALIFORNIA GOVERNMENT <br />CODE SECTION 8630 AND SAN LEANDRO MUNICIPAL CODE SECTION 3-4-124 BECAUSE OF THE COVID-19 <br />PANDEMIC <br />WHEREAS, emergency conditions presently exist in the City of San Leandro related to the COVID- <br />19 pandemic, all as described and in accordance with the City's Director of Emergency Services' March 16, <br />2020 proclamation of a local emergency and state of emergency, ratified by the City Council on March 16, <br />2020 by Resolution No. 2020-024, as a result of conditions described in the Director's proclamation; and <br />WHEREAS, cumulatively in Alameda County best estimates are that to date there have been 389,576 <br />cases, and 2,099 deaths due to COVID-19; and <br />WHEREAS, as of January 3, 2023, Alameda County Public Health estimates that there were 1,901 <br />probable cases of COVID-19 in San Leandro, justifying that COVID-19 continues to be a threat to public health; <br />and <br />WHEREAS, COVID-19 variants continue to be a major concern, most recently the Omicron variant and <br />its sub -variants that continue to infect individuals internationally, nationally, and locally, individuals who may <br />come into San Leandro and spread the sub -variants, increasing infection risks and threatening the public <br />health; and <br />WHEREAS, despite widespread availability of vaccines and that 87% of individuals in San Leandro have <br />received the primary vaccine series, and 51% have received the primary series and booster, only 10% of San <br />Leandro residents are estimated to have received the bivalent booster, which may affect infection rates <br />especially if sub -variants are resistant to the primary and secondary dosages; and <br />WHEREAS, the conditions described in the Director's proclamation and this resolution, as ratified by <br />Resolution No. 2020-024, continue to exist and are still deemed to warrant continued emergency actions to <br />preserve and protect public health, safety, welfare, and property; and <br />WHEREAS, on October 17, 2022, Governor Gavin Newsom announced that the COVID-19 State of <br />Emergency will end on February 28, 2023. <br />NOW, THEREFORE, THE CITY OF SAN LEANDRO CITY COUNCIL DOES RESOLVE that the emergency <br />conditions described in this resolution, the Director's proclamation of a local emergency and state of <br />emergency dated March 16, 2020, and ratified by the City of San Leandro City Council on March 16, 2020 by <br />passage of Resolution No. 2020-024 are determined, found, ratified and declared to continue to exist, and that <br />said conditions justify the continuation of a local emergency and state of emergency in the City of San <br />Leandro; and <br />BE IT FURTHER RESOLVED that the City Council determines, finds, ratifies and declares that the local <br />emergency will automatically terminate when the Governor terminates the State of Emergency or February <br />28, 2023, whichever is later. <br />
