IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2023-013 RESOLUTION APPROVING AMENDMENT NO. 2 TO THE CONSULTING SERVICES AGREEMENT FOR THIRD PARTY PLAN CHECK SERVICES BETWEEN THE CITY OF SAN LEANDRO AND TRB+ASSOCIATES (TO INCREASE THE CONTRACT BY $487,500 FOR AN AMOUNT NOT TO EXCEED $800,0000) AND APPROVING A TOTAL AMOUNT NOT TO EXCEED $987,500 FOR THE CITY'S THIRD PARTY PLAN CHECK SERVICES CONTRACTS WITH TRB+ASSOCIATES AND CSG CONSULTANTS, INC., IN FY2022-2023 WHEREAS, the original consulting services agreements (CSA) between the City of San Leandro and TRB+Associates ($250,000) and CSG Consultants, Inc. ($150,000), in a total amount not to exceed $400,000 was presented to and approved by this City Council on July 5, 2022 under Resolution No. 2022-113; and WHEREAS, the City Council is familiar with the contents thereof; and WHEREAS, amendments to the agreement to clarify the work or respond to atypical existing conditions are a normal aspect of public contracting and procurement of services; and WHEREAS, in order to expedite third party plan check projects on schedule and on budget, provide that the consultants are paid in a timely fashion, avoid as much as possible costly delay claims, and ensure that the City completes projects according to the City's highest standards, the City Council finds that providing authorization to the City Manager or his or her designee to negotiate amendments to the consulting services agreement is in the public's best interest; and WHEREAS, the City Manager, as authorized by City Council to administratively approve amendments up to 25% of the original contract amount, approved Amendment No. 1 to the CSA with TRB+Associates to increase the contract by $62,500 for an amount not to exceed $312,500 in December 2022; and WHEREAS, the City Manager recommends approval of the attached Amendment No. 2 to the CSA with TRB+Associates to increase the contract by $487,500 for an amount not to exceed $800,000 (Attachment A, Exhibit Al); and WHEREAS, the Amendment No. 2 will generate $487,500 in building permit revenues, which will offset the cost of the amendment; and WHEREAS, the City Manager recommends approval of a total not to exceed amount of $987,500 for both the combined FY2022-2023 third party plan check services contracts with TRB+Associates and CSG Consultants, Inc. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: Approve Amendment No. 2 to increase the total contract amount by $487,500 for the consulting services agreement with TRB+Associates in an amount not to exceed $800,000, and authorize execution by the City Manager. • A total not to exceed amount of $987,500 is approved for the combined contracts for TRB+Associates and CSG Consultants, Inc. in FY2022-2023.
