and the tenants or occupants of Licensee are collectively herein referred to as the "Other Parties") due to poor management and improper handling and disposal or storage of garbage, trash, cardboard, boxes, grease, fat and refuse by such Other Parties. All maintenance and repair responsibilities of the Licensee pursuant to the License Agreement shall not constitute a common area maintenance cost as such costs are defined in that certain Maintenance, Operation and Reciprocal Easement Agreement ("MOREA"), dated December 9, 1981, governing the use, operation and maintenance of the Center. 8. LICENSEE TO PAY COSTS Licensee shall pay all costs related to construction, reconstruction, maintenance and removal of improvements and equipment on or within the Licensed Premises. C, TERMINATION Upon termination of this License Agreement, whether by expiration of the term, by revocation of the license or otherwise, Licensee shall remove all business personal property, equipment and related items from the Licensed Premises and restore said area to the condition in which Licensee received said area, that is, prior to installation of aforesaid improvements, equipment, or business personal property. D. FEE Licensee shall pay to City the following amounts as consideration for the license granted to Licensee herein (the "Fee"): (a) for Years 1 through 5 of this Agreement the sum of $275.00 per month; (b) for Years 6 through 10 of this Agreement the sum of $295.00 per month; (c) for the first five year Option Term of this Agreement the sum of $305.00 per month; and (d) for the second five year Option Term of this Agreement the sum of $320.00 Exhibit C 2 of 4 License Agreement-Safeway 204057
