interest in the sole, exclusive, and absolute determination of the City. Notice of revocation pursuant to this <br />paragraph shall be served upon the Licensee in writing and Licensee shall vacate and cease using the <br />Licensed Property and remove all improvements thereon within ninety (90) days of receipt thereof. In lieu <br />of vacating the Licensed Property, Licensee may, during the ninety (90) day period, remedy such breach or <br />cease and desist from acts or omissions contrary to the public interest. City and Authority further reserve <br />the right, in addition to the remedy provided above, to enforce any breach or failure to perform under this <br />Agreement as provided in Paragraph 8, ENFORCEMENT, below. <br />7. HOLD HARMLESS. Licensee shall hold harmless and indemnify and defend the City, <br />Authority, Partners and Associates and their officers, agents and employees from and against all liability for <br />injury to persons, including Licensee, City, Authority, and their officers, agents and employees, and. <br />damage to property, including that of Licensee, City, and Authority arising from or in any way connected <br />with Licensee's use of the Licensed Property. <br />ENFORCEMENT, Licensee is responsible for maintaining the Licensed Property in <br />accordance with the terms of this Agreement, and with all applicable Federal, State, and City of San <br />Leandro laws, ordinances, rules and regulations, As long as Licensee is the owner or tenant of the <br />Safeway Parcel, Licensee is fully liable for, and responsible for abating, any violations committed by any <br />tenant of Licensee, or other occupant under authority of Licensee, of any portion of the Safeway Parcel, <br />including, but not limited to, Longs. <br />9. SPECIAL TERMS. In addition to the provisions of this Agreement, the special terms set <br />forth in Exhibit C, which is attached hereto and incorporated herein by this reference, shall apply. <br />10. PUBLIC LIABILITY COVERAGE AND CERTIFICATE OF INSURANCE. Licensee shall <br />obtain, and shall file with the City, certificates of insurance evidencing public liability coverage in such <br />amounts and including such endorsements as specified by the City and naming City and Authority, their <br />respective officers, officials, agents, employees, and volunteers as additional insureds.
