published in Section 6932 of Title 25 of the California Code of Regulations <br />("Regulations") or successor provision published pursuant to California Health <br />and Safety Code Section 50093(c). If HCD ceases to make such determination, <br />Area Median Income shall be the median income applicable to Alameda County, <br />with adjustments for Actual Household Size, as determined from time to time by <br />the U.S. Department of Housing and Urban Development ("HUD") pursuant to <br />the United States Housing Act of 1937 as amended, or such other method of <br />median income calculation applicable to the City of San Leandro that HUD may <br />hereafter adopt in connection with such Act. <br />1.3 "Assumed Household Size" means the household size "adjusted for family size <br />appropriate to the unit" in accordance with Health and Safety Code section <br />50052.5. <br />1.4 "Eligible Household" means a household for which total household income upon <br />initial occupancy has a One Hundred Percent (100%) of the Area Median Income. <br />1.5 "Household Income" shall mean the total anticipated annual income of all persons <br />in a household for the twelve-month period following the date of determination of <br />income pursuant to the method of calculation of gross income as provided in 25 <br />California Code of Regulations Section 6914. <br />1.6 "Project" shall mean the Property and the 196 units to be developed on the <br />Property, and any additional improvements and all landscaping, roads and parking <br />spaces existing thereon, as the same may from time to time exist. <br />1.7 "Qualifying Rent" means a monthly rent which does not exceed the amounts set <br />forth in Section 2.1 below. <br />1.8 "Rent" shall mean the total of monthly payments by the Tenants of a Restricted <br />Unit for the following: use and occupancy of the Restricted Unit and land and <br />associated facilities; any separately charged fees or service charges assessed by <br />Owner that are required of all tenants, other than security deposits; an allowance <br />for utilities paid by the tenant calculated as set forth below and including garbage <br />collection, sewer, water, electricity, gas and other heating, cooking and <br />refrigeration fuel, but not cable, internet, or telephone service; any other interest, <br />taxes, fees or charges for use of the land or associated facilities and assessed by a <br />public or private entity other than Owner, and paid by the Tenant on a non - <br />optional basis. Utility allowances shall equal the utility allowance published by <br />the Alameda County Housing Authority, or if no such allowance is published, by <br />a similar public agency approved by the City. <br />1.9 "Restricted Unit" means a dwelling unit which is reserved for occupancy at a <br />Qualifying Rent by an Eligible Household in accordance with and as set forth in <br />Sections 2.1 and 2.2. <br />1.10 "Tenant" shall mean a household occupying a Restricted Unit. <br />Affordable Housing Regulatory Agreement — Centro Callan <br />November 28, 2022 <br />
