IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2023- <br /> <br />RESOLUTION EXTENDING THE CONFIRMATION OF A PROCLAMATION <br />OF LOCAL EMERGENCY AND DECLARING ITS TERMINATION IN LINE WITH <br />THE TERMINATION OF THE GOVERNOR’S STATE OF EMERGENCY BY THE <br />CITY’S DIRECTOR OF EMERGENCY SERVICES PURSUANT TO CALIFORNIA <br />GOVERNMENT CODE SECTION 8630 AND SAN LEANDRO MUNICIPAL CODE <br />SECTION 3-4-124 BECAUSE OF THE COVID-19 PANDEMIC <br /> <br /> WHEREAS, emergency conditions presently exist in the City of San Leandro <br />related to the COVID-19 pandemic, all as described and in accordance with the City’s Director <br />of Emergency Services’ March 16, 2020 proclamation of a local emergency and state of <br />emergency, ratified by the City Council on March 16, 2020 by Resolution No. 2020-024, as a <br />result of conditions described in the Director’s proclamation; and <br /> <br /> WHEREAS, cumulatively in Alameda County best estimates are that to date there have <br />been 389,576 cases, and 2,099 deaths due to COVID-19; and <br /> <br /> WHEREAS, as of January 3, 2023, Alameda County Public Health estimates that there <br />were 1,901 probable cases of COVID-19 in San Leandro, justifying that COVID-19 continues to <br />be a threat to public health; and <br /> <br /> WHEREAS, COVID-19 variants continue to be a major concern, most recently the <br />Omicron variant and its sub-variants that continue to infect individuals internationally, <br />nationally, and locally, individuals who may come into San Leandro and spread the sub-variants, <br />increasing infection risks and threatening the public health; and <br /> <br />WHEREAS, despite widespread availability of vaccines and that 87% of individuals in <br />San Leandro have received the primary vaccine series, and 51% have received the primary series <br />and booster, only 10% of San Leandro residents are estimated to have received the bivalent <br />booster, which may affect infection rates especially if sub-variants are resistant to the primary <br />and secondary dosages; and <br /> <br />WHEREAS, the conditions described in the Director’s proclamation and this resolution, <br />as ratified by Resolution No. 2020-024, continue to exist and are still deemed to warrant <br />continued emergency actions to preserve and protect public health, safety, welfare, and property; <br />and <br /> <br /> WHEREAS, on October 17, 2022, Governor Gavin Newsom announced that the COVID- <br />19 State of Emergency will end on February 28, 2023. <br /> <br />NOW, THEREFORE, THE CITY OF SAN LEANDRO CITY COUNCIL DOES <br />RESOLVE that the emergency conditions described in this resolution, the Director’s <br />proclamation of a local emergency and state of emergency dated March 16, 2020, and ratified by <br />the City of San Leandro City Council on March 16, 2020 by passage of Resolution No. 2020-024 <br />are determined, found, ratified and declared to continue to exist, and that said conditions justify <br />the continuation of a local emergency and state of emergency in the City of San Leandro; and <br />
