IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2023-066 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A FIFTEENTH LETTER AMENDMENT TO THE FRANCHISE FOR SOLID WASTE, RECYCLABLES, AND GREEN WASTE BETWEEN THE CITY OF SAN LEANDRO AND ALAMEDA COUNTY INDUSTRIES, INC. WHEREAS, The City of San Leandro ("City") and Alameda County Industries ("ACI") executed that certain Franchise Agreement for Solid Waste, Recyclables and Green Waste Services between the City of San Leandro and Alameda County Industries, Inc., dated February 1, 2000 ("Franchise Agreement"); and WHEREAS, The Agreement is scheduled to expire on January 31, 2025; and WHEREAS, The City intends to enter into a two-step procurement process in which sole source negotiations are initiated with ACI, followed by a competitive procurement process if the sole source negotiations are not successful; and WHEREAS, A new franchise agreement shall be presented to the City Council for approval no later than May 15, 2024, as a result of the sole source negotiations; and WHEREAS, The City Manager, may determine that more time is required to continue such negotiations or that no such new franchise agreement can be reached, and have the sole option to extend the expiration date of the Agreement to Midnight on January 31, 2027; and WHEREAS, The City shall exercise the extension option, by written notice, no later than August 31, 2024; and WHEREAS, the Fifteenth Letter Amendment to the Franchise Agreement between the City and ACI, a copy of which is attached, contains the terms of the negotiations and extension. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That said Fifteenth Letter Amendment is hereby approved and execution by the City Manager is hereby authorized.
