RELOCATION PLAN – INTERIM SHELTER/NAVIGATION CENTER

Autotemp Page 15
7. Final payments will be issued after confirmation that the
Project area premises have been completely vacated, and
actual residency at the replacement unit is verified.

8. Receipts of payment will be obtained and maintained in
the relocation case file.

No household will be displaced until “comparable” housing is located as defined
above. Relocation staff will inspect any replacement units to which referrals are
made to verify that they meet all the standards of decent, safe, and sanitary as
defined in Section 24.2 (a) (8) of the Uniform Act.

No household will be entitled to a rental assistance or replacement housing payment
if it chooses to move to a replacement unit which does not meet the standards of
decent, safe, and sanitary housing.

K. RELOCATION TAX CONSEQUENCES

In general, relocation payments are not considered income for the purpose of the
Internal Revenue Code of 1986, or the Personal Income Tax Law, Part 10, of the
Revenue and Taxation Code. The above statement on tax consequences is not
intended to be provision of tax advice by the Developer, the City, their Agents,
Consultants or, Assigns. Displacees are encouraged to consult with their own,
independent tax advisors concerning the tax consequences of relocation payments.

L. APPEALS POLICY

The appeals policy and grievance procedure will follow the standards described in
Attachment 4. Briefly stated, the displaced tenants will have the right to ask for
review when there is a complaint regarding any of their rights to relocation and
relocation assistance, such as a determination as to eligibility, the amount of
payment, or the failure to provide a comparable replacement housing referral. The
hearing officer, Avalon Schultz, Assistant Community Development Director, is an
employee of the City who is outside the decision process. Ms. Schultz can be
contacted 835 East 14th Street, San Leandro, CA 94577; 510.577.3433; or
Aschultz@sanleandro.org. Any displaced person has the right to contact HCD for
the purpose of an appeal or grievance and those further details are found in
attachment 4
