improvements on the subject Property zoned Industrial General (IG) located at 1815 <br />Williams Street. The project also proposes to sub -divide an existing parcel into two <br />separate parcels with the existing industrial building to be at the northern parcel and the <br />new construction building to be at the southern parcel. <br />4. The project shall remain in substantial compliance with the approved exhibits and plans. <br />No application for amendment of the application or Conditions of Approval shall be <br />submitted or accepted for processing by the City unless (i) there is full compliance with <br />all terms of the application and Conditions of Approval; or (ii) the Zoning Enforcement <br />Official can waive compliance with the terms of the application if they are minor in <br />content. Revisions involving substantial changes in project design or conditions of <br />approval shall be treated as new applications in accord with Zoning Code Section <br />5.12.132.C. <br />5. Pursuant to Zoning Code Chapter 5.08, this approval shall lapse on April 11, 2024, unless <br />a permit has been issued for the improvements identified with this Site Plan Review Permit, <br />coupled with diligent progress evidencing good faith intention to commence the intended <br />use. <br />III. REQUIRED ON -SITE IMPROVEMENTS <br />6. Prior to issuance of building/grading permits, the applicant shall submit a final landscape <br />and irrigation plan to the Zoning Enforcement Official for review and approval. The plan <br />shall comply with the approved Preliminary Landscaping Plan (Exhibit D), with the City's <br />Landscape Ordinance, as codified in Article 19 of the San Leandro Zoning Code, and with <br />the State Model Water Efficient Landscape Ordinance (MWELO). Said plans shall <br />include such details as 1) tree size, species and location; 2) shrubs and groundcovers; 3) <br />installation specifications; 4) irrigation details; 5) water conservation techniques; and 6) <br />maintenance programs. <br />7. Prior to issuance of either a Certificate of Occupancy or Approval of the Final inspection <br />for the building/grading permits, the applicant shall submit a Certificate of Completion, <br />as defined in the State Model Water Efficient Landscape Ordinance (MWELO), to the <br />Zoning Enforcement Official for review and approval. All required landscaping and <br />irrigation shall be installed per the approved final landscape and irrigation plan, with <br />respect to size, number, and species of plants, and provision of adequate irrigation <br />coverage. The Certificate of Completion shall include, but is not limited to, certification <br />that the landscape project has been installed per the approved plans, pursuant to MWELO. <br />IV. ENGINEERING AND TRANSPORTATION DEPARTMENT REQUIREMENTS <br />8. Pursuant to Government Code Section 66020, including Section 66020 (d) (1), the City <br />HEREBY NOTIFIES the applicant for this Project that the 90-day approval period (in <br />which the applicant may protest the imposition of any fees, dedications, reservations, or <br />other exactions imposed on this Project by these Conditions of Approval) will begin on <br />the date of the conditional approval of this Project. If the applicant fails to file a protest <br />within this 90-day period, complying with all of the requirements of Government Code <br />Section 66020, the applicant will be legally barred from later challenging any such fees, <br />dedications, reservations or other exactions. <br />Conditions of Approval April 11, 2022 <br />PLN21-0026 1815 Williams Street Page 2 of 10 <br />
