IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2023-033 <br />RESOLUTION OF THE CITY OF SAN LEANDRO RATIFYING THE PROCLAMATION OF A LOCAL <br />EMERGENCY BY THE DIRECTOR OF EMERGENCY SERVICES RELATED TO THE PERSISTENT <br />STORM EVENTS <br />WHEREAS, the Emergency Services Act, California Government Code sections 8558(c) and 8630 <br />authorize the proclamation of a local emergency when conditions of disaster or extreme peril to the <br />safety of persons and property within the territorial limits of a city exist; and <br />WHEREAS, pursuant to California Government Code section 8630 such an emergency may be <br />proclaimed by the governing body or by an official designated by ordinance adopted by the governing <br />body; and <br />WHEREAS, subsections (a) and (b) of San Leandro Municipal Code section 3-4-124 provide that <br />the Director of Emergency Services is empowered to proclaim the existence of a "local emergency" if <br />the City Council is not in session; and <br />WHEREAS, whenever a local emergency is proclaimed by the Director, the City Council shall <br />take action to ratify the proclamation within seven (7) days thereafter or the local emergency will not <br />remain in effect; and <br />WHEREAS, since January 4, 2023 until present day severe rainfall commenced from a series of winter <br />storms prompting emergency proclamations and multiple hazard warnings from numerous Bay Area <br />jurisdictions of potential flooding and severe winds; and <br />WHEREAS, widespread flooding, heavy rains, and damaging winds persist, exacerbating land and <br />mud slides and local flooding; and <br />WHEREAS, due to already saturated soils and high winds, the threat of downed trees and fallen <br />branches is increased, potentially leading to power outages as power lines are struck, swollen creeks and <br />rivers eroding adjacent lands and causing dangerous conditions to public and private property; and <br />WHEREAS, the potential for flooding in low lying areas of San Leandro is high, as well as mud and <br />landslides in the City's higher elevations and hills. <br />NOW THEREFORE THE CITY OF SAN LEANDRO CITY COUNCIL DOES RESOLVE that it is hereby <br />proclaimed and ordered that the Proclamation of a Local Emergency, issued by the Director of Emergency <br />Services, is hereby ratified and confirmed; and <br />BE IT FURTHER RESOLVED, that during the existence of this local emergency the powers, functions, <br />and duties of the emergency organization of this City shall be those prescribed by State law, the City Charter, <br />ordinances, resolutions, and approved plans of the City of San Leandro. <br />
