IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2023-033 RESOLUTION OF THE CITY OF SAN LEANDRO RATIFYING THE PROCLAMATION OF A LOCAL EMERGENCY BY THE DIRECTOR OF EMERGENCY SERVICES RELATED TO THE PERSISTENT STORM EVENTS WHEREAS, the Emergency Services Act, California Government Code sections 8558(c) and 8630 authorize the proclamation of a local emergency when conditions of disaster or extreme peril to the safety of persons and property within the territorial limits of a city exist; and WHEREAS, pursuant to California Government Code section 8630 such an emergency may be proclaimed by the governing body or by an official designated by ordinance adopted by the governing body; and WHEREAS, subsections (a) and (b) of San Leandro Municipal Code section 3-4-124 provide that the Director of Emergency Services is empowered to proclaim the existence of a "local emergency" if the City Council is not in session; and WHEREAS, whenever a local emergency is proclaimed by the Director, the City Council shall take action to ratify the proclamation within seven (7) days thereafter or the local emergency will not remain in effect; and WHEREAS, since January 4, 2023 until present day severe rainfall commenced from a series of winter storms prompting emergency proclamations and multiple hazard warnings from numerous Bay Area jurisdictions of potential flooding and severe winds; and WHEREAS, widespread flooding, heavy rains, and damaging winds persist, exacerbating land and mud slides and local flooding; and WHEREAS, due to already saturated soils and high winds, the threat of downed trees and fallen branches is increased, potentially leading to power outages as power lines are struck, swollen creeks and rivers eroding adjacent lands and causing dangerous conditions to public and private property; and WHEREAS, the potential for flooding in low lying areas of San Leandro is high, as well as mud and landslides in the City's higher elevations and hills. NOW THEREFORE THE CITY OF SAN LEANDRO CITY COUNCIL DOES RESOLVE that it is hereby proclaimed and ordered that the Proclamation of a Local Emergency, issued by the Director of Emergency Services, is hereby ratified and confirmed; and BE IT FURTHER RESOLVED, that during the existence of this local emergency the powers, functions, and duties of the emergency organization of this City shall be those prescribed by State law, the City Charter, ordinances, resolutions, and approved plans of the City of San Leandro.
