IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2023-082 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNTIL TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE AMENDMENT NO. 2 FOR $123,900.00 TO THE INSTALLATION AGREEMENT BETWEEN THE CITY OF SAN LEANDRO AND CLIMATEC, LLC, TO INCLUDE INTERIM REPLACEMENT COMPONENTS OF THE HVAC SYSTEM AT THE SENIOR COMMUNITY CENTER, FROM ARPA ACCOUNT 190-17-801-5240 WHEREAS, on December 13, 2021, the City Council authorized the City Manager to enter into an Installation Agreement between the City of San Leandro and Climatec, LLC for energy -efficiency and resiliency projects located in various City buildings; and WHEREAS, on June 21, 2022, the City Council authorized the City Manager to approve Amendment No. 1 to the Installation Agreement between the City of San Leandro and Climatec, LLC to include replacement of the Senior Community Center's HVAC system; and WHEREAS, due to the long lead timeline for manufacturing the new unit, the City desires to have certain components replaced in the interim in order to improve functionality of the HVAC unit; and WHEREAS, ARPA funding is available for this additional work; and WHEREAS, all other conditions of the 2021 Installation Agreement and Amendment No. 1 remain in effect; and WHEREAS the City Council is familiar with the contents of Amendment No. 2; and WHEREAS, the City Manager recommends approval of said amendment. NOW, THEREFORE, the City of San Leandro City Council does RESOLVE as follows: 1. That said Amendment No. 2 to the Installation Agreement is hereby approved and execution by the City Manager is hereby authorized.
