IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO.2022-157 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A CONSULTING SERVICES AGREEMENT WITH RRM DESIGN GROUP FOR LANDSCAPE ARCHITECTURAL SERVICES FOR THE STEVEN TAYLOR SANCTITY OF LIFE MEMORIAL PROJECT, PROJECT NO.2022.0340; TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND APPROVE INDIVIDUAL CONTRACT AMENDMENTS UP TO 5% OF THE ORIGINAL CONTRACT AMOUNT; AND TO AUTHORIZE THE CITY MANAGER TO NEGOTIATE AND APPROVE CUMULATIVE CONTRACT AMENDMENTS UP TO 10% OF THE ORIGINAL CONTRACT AMOUNT WHEREAS, an agreement between the City of San Leandro and RRM Design Group, a copy of which is attached, has been presented to this City Council; and WHEREAS, a corresponding appropriation for this proposed agreement is already incorporated into the proposed Fiscal Year 2022-2023 budget; and WHEREAS, RRM Design Group has agreed to the terms of the contract pending Council approval; and WHEREAS the City Council is familiar with the contents of the agreement; and WHEREAS, the City Manager recommends approval of said agreement. NOW, THEREFORE, the City of San Leandro City Council does RESOLVE as follows: That said agreement is hereby approved and execution by the City Manager is hereby authorized; and That the City Manager is authorized to make non -substantial revisions to said agreement, subject to approval as to form by the City Attorney; and That the City Manager is authorized to negotiate and approve individual contract amendments up to 5% of the original contract amount; and That the City Manager is authorized to negotiate and approve cumulative contract amendments up to 10% of the original contract amount.
