CAPER 15 <br />OMB Control No: 2506-0117 (exp. 09/30/2021) <br />CR-35 - Other Actions 91.220(j)-(k); 91.320(i)-(j) <br />Actions taken to remove or ameliorate the negative effects of public policies that serve as <br />barriers to affordable housing such as land use controls, tax policies affecting land, zoning <br />ordinances, building codes, fees and charges, growth limitations, and policies affecting the <br />return on residential investment. 91.220 (j); 91.320 (i) <br />The City continues to work towards eliminating housing constraints that are identified in the 2023-2031 <br />General Plan Housing Element, certified by HCD in February, 2023. <br />The State of CA provided SB2 “Building Homes and Jobs Act” funding for the City to evaluate the General <br />Plan and Zoning Ordinance. The City proposed to develop objective design and development standards <br />intended to stimulate high quality multi-family residential and mixed-use development. The intent of <br />this project is to signal to housing developers what the City wants to see in their proposed multi-family <br />residential and mixed-use developments thereby creating predictability and saving time in the <br />In 2016 and 2020, the City updated its Zoning Code to create more flexibility to meet market demands <br />while ensuring compatibility with existing neighboring uses. <br />Actions taken to address obstacles to meeting underserved needs. 91.220(k); 91.320(j) <br />The City addresses the underserved needs through the following: 1) Fostering and Maintaining <br />Affordable Housing, and 2) Eliminating Barriers to Affordable Housing. <br />Fostering and Maintaining Affordable Housing <br />• The City has regulatory agreements that require annual monitoring of approximately 620 Below- <br />Market Rate (BMR) rental units and 50 inclusionary BMR home ownership units. <br />• The City continues to respond to inquiries from private and non-profit developers to acquire <br />property and rehabilitate or construct new affordable rental units. <br />• The City's Minor Home Repair Program provided funding to twenty (20) single-family owner- <br />occupied home (see CR-20 – Affordable Housing). The Program continues to preserve and <br />improve the City' existing housing stock and assist senior homeowners with aging in place. <br />• The City's Rent Review Program, funded by City General Funds, provides a non-binding <br />arbitration board that reviews eligible rent increase cases in San Leandro. <br />• The City adopted a Mobile Home Space Rent Stabilization Ordinance (MHSRSO) with the goal of <br />preserving affordable housing for approximately 855 mobile home space tenants located in the <br />nine mobile home parks throughout San Leandro. <br /> <br />Eliminating Barriers to Affordable Housing <br />• The City's certified 2023-2031 General Plan Housing Element identifies barriers and <br />implementation strategies eliminate barriers to affordable housing in "Goal 58: Elimination of <br />Housing Constraints". The 2023-2031 Housing Element also includes a section on the City’s <br />efforts to Affirmatively Further Fair Housing.
