IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2023-146 <br />RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO ENTER INTO A CONSULTING SERVICES <br />AGREEMENT WITH SCHAAF AND WHEELER FOR THE DESIGN OF STORMWATER TRASH CAPTURE DEVICES, <br />PROJECT NO. 2017.0540 FOR $675,000.00; TO AUTHORIZE INDIVIDUAL AGREEMENT AMENDMENTS UP TO <br />10% (OR $67,500.00) OF THE ORIGINAL CONTRACT AMOUNT; AND TO AUTHORIZE CUMULATIVE <br />AGREEMENT AMENDMENTS UP TO 30% (OR $202,500.00) OF THE ORIGINAL CONTRACT AMOUNT <br />WHEREAS, this design work is necessary to meet the requirements of the San Francisco Municipal <br />Regional Stormwater National Pollutant Discharge Elimination System Permit and the City's Trash Load <br />Reduction Plan filed with the Alameda County Clean Water Program; and <br />WHEREAS, an agreement between the City of San Leandro and Schaaf and Wheeler is presented to this <br />City Council; and <br />WHEREAS, the City Council is familiar with the scope of work and compensation schedule for the <br />agreement; and <br />WHEREAS, the City Manager recommends approval of said agreement. <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: <br />• That said agreement substantially in the form presented is hereby approved and execution by the <br />City Manager is hereby authorized; and <br />• That the City Manager is authorized to make non -substantial revisions to said agreement, subject <br />to approval as to form by the City Attorney; and <br />• That an original executed agreement shall be attached to and made a part of this resolution; and <br />• That the City Manager or her designee is authorized to negotiate and approve individual agreement <br />amendments to the consulting services agreement up to 10% (or $67,500.00) of the original <br />agreement amount; and <br />• That the City Manager or her designee is authorized to negotiate and approve agreement <br />amendments to the consulting services agreement up to a cumulative value not to exceed 30% (or <br />$202,500.00) of the original agreement amount. <br />
