IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2023-158 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A GRANT OF EASEMENT WITH BANDWIDTH IG, LLC (GRANT OF AN EASEMENT OVER CITY PROPERTY FOR FIBER OPTIC CABLE SYSTEM) WHEREAS, the City of San Leandro ("San Leandro") is the owner of certain real property (the "Easement Area") located within the City of San Leandro and more particularly described in Exhibit A to the Easement Agreement attached hereto and incorporated herein by this reference; and WHEREAS, Bandwidth desires to construct, install and maintain a Fiber Optic Cable System as necessary within certain City -owned property; and WHEREAS, on September 18, 2023, the City Council affirmed its support of the project by approving a lease agreement of the Easement Area; and WHEREAS, the Easement is necessary for placing the Fiber Optic Cable System; and WHEREAS, a post -construction survey will be conducted to accurately map the marine portion of the installation; and WHEREAS, the City Manager recommends approval of said Grant of Easement. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: 1. That said Grant of Easement substantially in the form presented is hereby approved and execution by the City Manager is hereby authorized; and 2. That the City Manager is authorized to make non -substantial revisions to said Grant of Easement, subject to approval as to form by the City Attorney; and 3. That an original executed Grant of Easement shall be attached to and made a part of this resolution.
