IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2023-162 RESOLUTION OF THE CITY OF SAN LEANDRO CITY COUNCIL TO APPROVE CALRECYCLE GRANT APPLICATIONS FOR ALL INDIVIDUAL GRANTS FOR WHICH THE CITY OF SAN LEANDRO IS ELIGIBLE; AND TO AUTHORIZE THE CITY MANAGER OR HER DESIGNEE TO EXECUTE ALL DOCUMENTS PERTAINING TO THIS RESOLUTION AND THE ADMINISTRATION OF THE GRANT AWARDS WHEREAS, Public Resources Code section 48000 et seq., 14581, and 42023.1(g), authorizes the Department of Resources Recycling and Recovery (CalRecycle) to administer various grant and payment programs in furtherance of the State of California's (State) efforts to reduce, recycle, and reuse solid waste generated in the State thereby preserving landfill capacity and protecting public health and safety and the environment; and WHEREAS, in furtherance of this authority, CalRecycle is required to establish procedures governing the administration of its payment programs; and administration of the application, awarding, and management of its grant programs; and WHEREAS, CalRecycle's procedures for administering payment and grant programs require, among other things, an applicant's governing body to declare by resolution certain authorizations related to the administration of the payment and grant program; and WHEREAS, the City Council is familiar with the terms of the applications; and WHEREAS, the City Manager recommends approval of said applications. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: 1. That the City of San Leandro is authorized to submit all applications to CalRecycle for any and all grant and payment programs offered for which the City is eligible; and 2. That the City Manager or her designee is hereby authorized to execute in the name of the City of San Leandro all documents, including but not limited to, applications, agreements, amendments and requests for payment, necessary to secure funds and implement the approved grant or payment project; and 3. That the terms of the application and any subsequent grant documentation will be memorialized in writing by the City Manager, subject to approval as to form by the City Attorney; and 4. Be it further resolved that these authorizations are effective for five years from the date of adoption.
