IT IS FURTHER RESOLVED, that the City Council hereby authorizes the City Manager or their designee <br />to identify sites appropriate for emergency and transitional/interim housing activities and facilities, including <br />for safe parking of recreational vehicles and/or passenger vehicles, on properties owned or leased by the city <br />and to enter into licenses or leases of such properties with homeless service providers at below market rent or <br />with no administrative fees, for terms extending through the duration of the declared shelter crisis, in order to <br />facilitate the use of public land for emergency shelter operations and/or transitional/interim housing; and <br />IT IS FURTHER RESOLVED, that for the duration of this Emergency Proclamation and the Ratification <br />thereof, the City Council hereby authorizes the City Manager or their designee to renew existing professional <br />services agreements and/or grant agreements with homeless service providers that meet the performance <br />outcomes specified in such agreements using funding sources appropriated for emergency shelter or <br />transitional housing programs; and <br />IT IS FURTHER RESOLVED, that the City Council hereby declares that this Emergency Resolution is <br />necessary for preserving the public health and safety for the reasons stated herein, and there is a necessity to <br />immediately pass this Emergency Resolution pursuant to the powers given to the City Council under an <br />emergency declaration. This Resolution shall be effective immediately upon its adoption by an affirmative vote <br />of four (4) members of the City Council pursuant to the City Charter; and <br />IT IS FURTHER RESOLVED, that this Emergency Resolution is enacted pursuant to the City of San <br />Leandro’s general police powers, and Article XI of the California Constitution, as well as the other provisions of <br />state and local law otherwise cited herein; and <br />IT IS FURTHER RESOLVED, that if any section, subsection, sentence, clause or phrase of this Emergency <br />Resolution is for any reason held to be invalid or unconstitutional by decision of any court of competent <br />jurisdiction, such decision shall not affect the validity of the remaining portions of the Chapter. The San <br />Leandro City Council hereby declares that it would have passed this Emergency Resolution and each section, <br />subsection, clause or phrase thereof irrespective of the fact that one or more other sections, subsections, <br />clauses or phrases may be declared invalid or unconstitutional. <br />Introduced by __________________ and passed and adopted this 6th day of November 2023, by the <br />following vote: <br /> <br />AYES: <br /> <br />NOES: <br /> <br />ABSENT: <br /> <br />ATTEST: <br /> Kelly B.
