File Number: 23-394 <br />3.0 funding has not been released to the City by the close of escrow in Fall 2023. <br />·June 5, 2023 - City Council approved the submittal of Project HomeKey Round 3 <br />application to State HCD. <br />Applicable General Plan Policies <br />·Goal 58: Special Needs Populations - Proactively address the special housing needs <br />of the community, including seniors, disabled individuals, single parents, large families, <br />and the homeless. <br />o Action 58.09-B Transitional/Permanent Supportive Housing - Continue to <br />provide financial support to develop and operate supportive and transitional <br />housing facilities, including those located in nearby communities that are <br />accessible to persons who are homeless or at risk of homelessness in San <br />Leandro. <br />o Policy 58.11 Service Enriched Housing - Promote social services and programs <br />in affordable housing projects that assist lower-income households in obtaining <br />the financial resources needed to increase and stabilize their housing choices in <br />the City. <br />Environmental Review <br />The ground lease and operating subsidy agreement are exempt from California Environmental <br />Quality Act (CEQA) per CEQA Guidelines section 15301 because the project contemplated by <br />the proposed agreements consists of only minor alternations to existing structures. No new <br />structures will be constructed or expanded as part of the project. <br />Prior to close of escrow, the City will complete required federal National Environmental <br />Protection Act (NEPA) environmental review for the acquisition and rehabilitation of the <br />Property to release the use of the City’s federal Community Development Block Grant <br />(CDBG), Home Investment Program (HOME) and HOME-ARPA (via Alameda County) <br />funding for acquisition, rehabilitation and/or relocation related to the proposed project at 555 <br />Lewelling. <br />Legal Analysis <br />The City Attorney’s Office reviewed and approved as to form this staff report and resolution <br />and drafted the ground lease and operating subsidy agreement. <br /> <br />Financial Impacts <br />For the $5.2 million Rehabilitation Grant under the Ground Lease, the City expects the funding <br />sources to be primarily State HomeKey and AB 102 (Budget Act of 2023) funding, although <br />the City reserves the right to use other available local, State, and federal funds available to <br />the project for rehab, operations and/or services as needed per Attachment D (Summary of <br />Funding Sources).
