File Number: 23-556 <br />on neighboring properties or surrounding businesses. <br />Findings of Fact <br />To approve the proposed Zoning Map Amendment, Site Plan Review, Conditional Use Permit <br />and Administrative Exception (Height) the City Council must make certain findings of fact <br />and/or determinations pursuant to Zoning Code Sections 5.16.116, 5.08.124 and 4.08.116. <br />Staff analyzed the proposal and determined that the required findings can be made, as <br />detailed in Attachment E. <br />Environmental Review <br />Pursuant to the California Environmental Quality Act (CEQA), an Initial Study and Mitigated <br />Negative Declaration (IS/MND) (Exhibit A to Attachment A) were prepared for the project, <br />which conclude that with mitigation, any potential environmental impacts would be less than <br />significant. The IS/MND was circulated to various agencies for a 20-day public review period <br />(October 6, 2023, through October 27, 2023), and the document was posted on the City ’s <br />website. During the public review period, staff received comments from East Bay Municipal <br />Utility District, which provided requirements for water service, and the Confederated Villages <br />of Lisjan Nation, which requested copies of the research records for cultural resources <br />(Attachment D). <br />Planning Commission Review and Actions <br />The Planning Commission held a public hearing on the proposed project on November 2, <br />2023. The Commission requested clarifications from staff and the applicant on various topics, <br />including the IS/MND, provision of outdoor space for office users, and potential future uses of <br />the building. One public comment was made by a representative of the carpenters labor <br />union. The Commission inquired whether skilled labor would be utilized for the project. The <br />applicant clarified that a determination had not been made and a contractor would be selected <br />following preparation of the construction drawings. Following questions and deliberation, the <br />Planning Commission ultimately voted 4-2-1 (Boldt and Mendoza dissenting; Solis absent) to <br />recommend City Council approval of the project with slight modifications to the conditions of <br />approval. <br />Summary of Public Outreach Efforts <br />Notice for Planning Commission and City Council hearings on this item included legal <br />advertisement in the East Bay Times Daily Review newspaper, a 500-foot radius mailer to <br />property owners, and postings on site and at City Hall.
