Environmental Checklist <br />Biological Resources <br /> <br />Draft Initial Study – Mitigated Negative Declaration 47 <br />roosting (e.g., guano, urine staining and scent, dead bats) no more than 14 days before the start of <br />disturbance, including vegetation removal. If active roosts are discovered, a protection zone of no <br />less than 50 feet around the active roost shall be established by the qualified biologist. Disturbance <br />may occur within the once active roosting ceases, as determined by the qualified biologist. <br />Significance After Mitigation <br />Implementation of Mitigation Measure BIO-1 would reduce the potential for project construction <br />activities to result in the loss of active bird nests through a pre-construction nesting bird survey and <br />establishment of avoidance buffers around active nests, if present. Implementation of Mitigation <br />Measure BIO-2 would reduce the potential for project construction activities to result in the loss of <br />bat roosts through a pre-construction survey and establishment of avoidance buffers around active <br />roosts, if present. Implementation of these measures would reduce project impacts to special-status <br />plant and wildlife species to a less-than-significant level. <br />LESS THAN SIGNIFICANT WITH MITIGATION INCORPORATED <br />c. Would the project have a substantial adverse effect on state or federally protected wetlands <br />(including, but not limited to, marsh, vernal pool, coastal, etc.) through direct removal, filling, <br />hydrological interruption, or other means? <br />The National Wetlands Inventory (NWI) was reviewed to determine if wetland and/or non-wetland <br />waters had been previously documented and mapped on or in the vicinity of the project site <br />(USFWS 2020). No such features occur on or adjacent to the project site. As described in Setting, the <br />nearest creeks (San Leandro Creek and San Lorenzo Creek) are approximately 1.5 miles and 2.2 <br />miles from the project site, respectively. Construction and operation of the proposed project would <br />not involve or require the direct removal, filling, hydrological interruption, or other means to the <br />bed, bank, channel, or adjacent upland area of any creek or wetland. No impact would occur. <br />NO IMPACT <br />e. Would the project conflict with any local policies or ordinances protecting biological resources, <br />such as a tree preservation policy or ordinance? <br />As described in the Project Description, construction activities associated with the proposed project <br />would result in the removal of ten trees. As shown in the arborist report prepared for the project <br />site, none of these trees are street trees and therefor are not subject to SLMC Chapter 5-2 <br />(Appendix A). Further, the trees are not designated as historic resources and would not be subject <br />to SLMC Chapter 4-26. Therefore, the project would not conflict with policies regarding tree <br />preservation in SLMC. Impacts would be less than significant. <br />LESS-THAN-SIGNIFICANT IMPACT <br />f. Would the project conflict with the provisions of an adopted Habitat Conservation Plan, Natural <br />Community Conservation Plan, or other approved local, regional, or state habitat conservation <br />plan? <br />The project site is not located in an adopted Habitat Conservation Plan, Natural Community <br />Conservation Plan, or other approved local, regional, or state habitat conservation plan (City of San <br />Leandro 2016b). Therefore, the project would not conflict with such a plan and no impact would <br />occur. <br />NO IMPACT
