City of San Leandro <br />City Council <br />Meeting Date: December 4, 2023 <br />Agenda Number: 5.f. <br />Agenda Section: CONSENT CALENDAR <br />File Number: 23-579 <br />File Type: Staff Report <br /> <br />Adopt a Resolution to Approve Policies and Procedures for Providing Priority Sewer Service to <br />Affordable Housing Projects Pursuant to Government Code Section 65589.7  <br /> <br />COUNCIL PRIORITY   <br />·Housing and Homelessness  <br />  <br />SUMMARY  <br />State law requires public and private entities that provide water and sewer service to adopt <br />written policies and procedures to ensure that priority for these services are granted to <br />housing development projects that include units affordable to lower-income households. <br />Although the City has not denied service to such housing developments, staff recommends <br />that policies and procedures be approved in order to document San Leandro’s commitment to <br />affordable housing and to comply with State requirements. The attached resolution and <br />proposed policies and procedures have been drafted in accordance with Government Code <br />Section 65589.7. <br />  <br />RECOMMENDATIONS  <br />Staff recommends that Council adopts a resolution approving policies and procedures for <br />granting priority sewer service to housing development projects that include units affordable to <br />lower income households. <br />  <br />BACKGROUND  <br />California Government Code Section 65589.7 requires water and sewer providers to grant <br />priority for service provision to proposed developments that include housing units affordable to <br />lower-income households, and to adopt written policies and procedures to establish such <br />priority. Adoption of the policies and procedures will document City of San Leandro’s Water <br />Pollution Control Division’s compliance with State law and is required for State approval of the <br />City’s Housing Element. <br />  <br />Analysis  <br />The City of San Leandro’s Housing Element Update Action 10.8 states, “Adopt written policies <br />and procedures for the City of San Leandro Water Pollution Control Division that grant priority <br />to proposed developments that include housing affordable to lower-income households <br />pursuant to Government Code Section 65589.7. Coordinate with the Oro Loma Sanitary <br />District regarding written procedures to prioritize housing developments that include housing <br />affordable to lower-income households.” This requires that the City adopt written policies and <br />procedures in compliance with the state requirements for housing element adoption. <br />  <br />Financial Impacts  <br />Page 1 City of San Leandro Printed on 12/21/2023
