City of San Leandro <br />City Council <br />Meeting Date: January 2, 2024 <br />Agenda Number: 5.b. <br />Agenda Section: CONSENT CALENDAR <br />File Number: 23-628 <br />File Type: Staff Report <br />Adopt a Resolution to Approve the Appointment of Retired Annuitant Kevin Hart as Interim Police <br />Chief Pursuant to Government Code §7522.56 and §21221(g) <br />COUNCIL PRIORITY <br />•Public Safety <br />•Infrastructure <br />SUMMARY AND RECOMMENDATIONS <br />Staff recommends that the City Council adopt a resolution approving the appointment of Kevin <br />Hart as Interim Police Chief retroactive to October 1, 2023 pursuant to Government Code § <br />21221(g) for temporary employment as a retired annuitant while Police Chief Abdul Pridgen is <br />on a leave. <br />BACKGROUND <br />Police Chief Abdul Pridgen is currently on administrative leave for an undefined period of time. <br />Kevin Hart was appointed by the City Manager to serve as the Interim Police Chief beginning <br />October 1, 2023. <br />Analysis <br />In order to comply with Government Code §21221(g), CalPERS has advised staff that the City <br />Council must adopt a resolution approving the interim appointment of Mr. Hart. Such a <br />resolution is required when a retired annuitant is employed to fill a position because of a leave <br />of absence that is granted to a person on payroll status for a period not to exceed one year <br />and found by the governing body to require specialized skills. This appointment will also be <br />subject to applicable laws under Government Code §7522.56(d), which limits the number of <br />hours to 960 hours in a fiscal year. <br />Mr. Hart has over 35 years of experience in sworn law enforcement, including 15 years in <br />leadership roles with city and county governments and previous experience as the Chief of <br />Police in two other police agencies. <br />Fiscal Impacts <br />This action will not impact fund balance because sufficient funds are included in the Fiscal <br />Year 2023-2024 adopted budget. For this position, the applicable hourly rate is $145.70, <br />which is equivalent to the base salary for Police Chief on the approved salary schedule. In <br />accordance with the applicable laws, a retired annuitant does not receive any other benefit, <br />incentive compensation in lieu of benefits, or any other form of compensation in addition to <br />Page 1 City of San Leandro Printed on 12/21/2023
