IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2024-016 <br />RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE AN AGREEMENT WITH PACIFIC <br />WEST COMMUNITIES AND THE BAY AREA RAPID TRANSIT DISTRICT, SUBMIT AN APPLICATION TO THE <br />CALIFORNIA DEPARTMENT OF HOUSING AND COMMUNITY DEVELOPMENT FOR AFFORDABLE HOUSING AND <br />SUSTAINABLE COMMUNITIES PROGRAM FUNDS, AND EXECUTE DOCUMENTS TO ACCEPT THE PROGRAM FUNDS <br />WHEREAS, the State of California is accepting applications for funding under the Affordable Housing and <br />Sustainable Communities (AHSC) Program established under Division 44, Part 1 of the Public Resources Code <br />commencing with Section 75200; and <br />WHEREAS, the City of San Leandro, Bay Area Rapid Transit District, and Pacific West Communities <br />each have projects that when combined qualify for funding under the Program; and <br />WHEREAS, only two entities can be listed on the funding application. <br />NOW, THEREFORE, the City of San Leandro City Council does RESOLVE as follows: <br />That the City Manager shall submit on behalf of the City an AHSC Program Application as co- applicant with <br />Pacific West Communities in a total amount not to exceed $50,000,000 of which up to $35,000,000 is requested as <br />a loan for an Affordable Housing Development, and upto $15,000,000 is requested for a grant for Housing -Related <br />Infrastructure, Sustainable Transportation Infrastructure, Transit -Related Amenities, or Program activities as <br />defined in the AHSC Program Guidelines; and <br />That the City Manager may enter into an agreement with BART obligating BART to construct certain <br />improvements and obligating the City to forward certain proceeds from the Program Funds to BART, in the event <br />the Program Funds are awarded to the City; and <br />That if the application is approved, the City Manager may execute a State of California Standard Agreement in a <br />total amount not to exceed $15,000,000, and any and all other documents required or deemed necessary or <br />appropriate to secure the AHSC Program funds from the Department and all amendments thereto including an AHSC <br />Program Application and AHSC Documents as required by the Department for participation in the AHSC Program, and <br />That the City Manager is authorized to make non -substantial revisions to said agreement with BART, subject to <br />approval as to form by the City Attorney. <br />Introduced by Councilmember Aguilar and passed and adopted this 41h day of March 2024 by the following vote: <br />AYES: Councilmembers Aguilar, Azevedo, Ballew, Bowen, Simon, Walton, and Mayor Gonzalez (7) <br />NOES: None (0) <br />ABSENT: None (0) <br />ATTEST: L t. � � <br />e ly B. 4ncy, CIVIC <br />City Clerk <br />
