IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2024-029 RESOLUTION TO ADOPT A MITIGATED NEGATIVE DECLARATION FOR THE SAN LEANDRO WATER POLLUTION CONTROL PLANT TREATMENT WETLAND AND SHORELINE RESILIENCE PROJECT IN ACCORDANCE WITH THE REQUIREMENTS OF THE CALIFORNIA ENVIRONMENTAL QUALITY ACT WHEREAS, the San Leandro Water Pollution Control Plant Treatment Wetland and Shoreline Resilience Project (Project No. RA-007) (“Project”) would convert a 6.9-acre wastewater storage basin into a multi-benefit freshwater treatment wetland; and WHEREAS, on October 15, 2018, the City received a grant from the San Francisco Bay Restoration Authority to partially fund the design and permitting processes of the Project; and WHEREAS, on October 7, 2019, City Council approved a contract to provide design services for the Project; and WHEREAS, pursuant to the provisions of the California Environmental Quality Act of 1970 (Public Resources Code Section 21000 et seq.) (“CEQA”) and the State CEQA Guidelines (California Code of Regulations, Title 14, Section 15000 et seq.) ("CEQA Guidelines"), the City prepared an Initial Study and draft Mitigated Negative Declaration (State Clearinghouse No. 2024020945) (“IS/MND”) for the Project; and WHEREAS, the IS/MND concluded that the project would not result in any significant impacts with the incorporation of mitigation measures; and WHEREAS, a Mitigation Monitoring and Reporting Program (“MMRP”) is incorporated into the IS/MND; and WHEREAS, on February 23, 2024, the City issued a Notice of Intent to Adopt a Mitigated Negative Declaration for the Project in accordance with the requirements of CEQA; and WHEREAS, the IS/MND for the Project was circulated for public review and comment for a period between February 23, 2024 to March 25, 2024; and WHEREAS, no comments were received during the public review period; and WHEREAS, a City Council staff report dated April 2, 2024, and incorporated herein by reference, describes and analyses the proposed Project and IS/MND, and reflects the City’s independent judgment; and WHEREAS, on April 2, 2024, the City Council independently reviewed and fully considered the IS/MND, staff report, all written and oral statements received, other pertinent documents, and all other testimony and evidence presented. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE that the foregoing recitals are correct and true and made part of this resolution; and BE IT FURTHER RESOLVED THAT, the City Council of the City of San Leandro does hereby adopt the Mitigated Negative Declaration (Exhibit A) for the Project based on the following findings and considering the whole of the record related to the Project:
