The treatment plan should include provisions for analyzing the data <br />in a regional context, timely reporting of results, proper curation of artifacts and data in an approved <br />facility, and dissemination of the reports to local and state repositories, libraries, and interested <br />professionals. <br />c) Disturbance to human remains. The Project area does not show any signs of being used for burial <br />purposes, either in recent times or in the distant past. However, if human remains are unexpectedly <br />found during the construction of the Project, all work in the vicinity will be immediately stopped. <br />Disturbing human remains would be considered a potentially significant impact. To address this, the <br />following mitigation measure has been established to reduce any potential impacts to a level that is <br />less than significant. <br />Impact Designation: Less than Significant with Mitigation <br />Mitigation Measure CR-2: Inadvertent Discovery of Human Remains. <br />If human remains are discovered during construction activities, all work within 100 feet of the site <br />must stop immediately. The Alameda County Coroner must be notified to ascertain whether an <br />investigation into the cause of death is necessary. If the remains are determined to be Native <br />American, the Native American Heritage Commission (NAHC) must be contacted within 24 hours. <br />The NAHC will identify the person or persons believed to be the most likely descendant(s) of the <br />deceased Native American. These individuals will then provide recommendations to San Leandro <br />regarding the proper treatment of the human remains and any associated grave goods. <br />Cumulative Impacts on Cultural Resources <br />The scope of cumulative impacts associated with cultural resources is focused on areas nearby where the <br />Project could disturb historical and archaeological resources, or human remains. Since the Project is not <br />expected to impact historical structures or paleontological resources, no significant cumulative impact is <br />anticipated in these areas. However, both this Proposed Project and other future projects in the vicinity may <br />affect undiscovered archaeological resources or human remains during construction. The combined potential <br />impacts of these projects could be significant regarding buried archaeological resources or human remains. <br />Nonetheless, the application of Mitigation Measures CR-1 and CR-2, which mandate halting work for <br />evaluation by a qualified archaeologist or the County Coroner in case of finding human remains, will minimize <br />these impacts. Additionally, other projects undergoing CEQA review will implement similar discovery protocols. <br />Therefore, with these mitigation measures in place, the Project's contribution to cumulative impacts on <br />archaeological resources or human remains is deemed not considerable, leading to a less than significant <br />impact. <br />San Leandro Treatment Wetland <br />IS/MND <br />February 2024 <br />
