IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2024-055 RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE AMENDMENT NO. 6 TO THE SERVICE CONTRACT WITH THE STATE OF CALIFORNIA DEPARTMENT OF TRANSPORTATION; TO APPROPRIATE ADDITIONAL REIMBURSABLE FUNDS IN THE AMOUNT OF $210,000; AND TO REAPPROPRIATE REIMBURSABLE FUNDS FROM PREVIOUS AMENDMENT NO. 3 IN THE AMOUNT OF $150,000 FOR THE SECTION 130 GRADE CROSSING IMPROVEMENT PROGRAM FOR THE WASHINGTON/CHAPMAN RAILROAD CROSSING IMPROVEMENT PROJECT, PROJECT NO. 2016.0320 (AGREEMENT WITH UNION PACIFIC RAILROAD COMPANY (UPRR) TO ALLOW IMPROVEMENTS AT THE WASHINGTON/CHAPMAN RAILROAD CROSSING AND APPROVE AND APPROPRIATE GRANT FUNDS FOR THE PROJECT) WHEREAS, the City entered into a Service Contract with CalTrans to construct the programmed highway improvements at the Washington/Chapman Railroad Crossing; and WHEREAS, the California Public Utilities Commission (CPUC), through Section 130, previously approved $150,000 in federal funding for the construction of highway improvements at the Washington/Chapman Railroad Crossing via Grant Amendment No. 3 to the Service Contract; and WHEREAS, the CPUC, through Section 130, approved an additional $210,000 in federal funding for the construction of highway improvements at the Washington/Chapman Railroad Crossing via Grant Amendment No. 6 to the Service Contract; and WHEREAS, the CPUC also approved a grant extension through June 30, 2025 for the construction of highway improvements at the Washington/Chapman Railroad Crossing via Grant Amendment No. 6 to the Service Contract; and WHEREAS, the City Council is familiar with the contents thereof; and WHEREAS, the City Manager recommends approval of said Grant Amendment No. 6. NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That said Service Contract Amendment No. 6 is hereby approved and execution by the City Manager is hereby authorized; and That $360,000 in Account No. 150-38-387 is appropriated for the subject project; and That the City Manager is authorized to take all actions, and execute all documents necessary, subject to approval as to form by the City Attorney, to effect this Resolution.
