COMPLIANCE WITH APPROVED PLANS <br />A. The applicant and/or property owner and project shall comply with Exhibits A through <br />F, attached to the staff report dated May 7, 2020, except as hereinafter modified. <br />Exhibits are on file at the City of San Leandro Community Development Department, <br />835 East 14th Street, San Leandro, California. <br />Exhibit A — Project Data and Contents (a0.00) <br />Exhibit B — Restrooms/Accessibility (a0.03) <br />Exhibit C — Demolition Plan (a1.00) <br />Exhibit D — Proposed Plan (a2.00) <br />Exhibit E — Exterior Elevations (a3.00) <br />Exhibit F — Mep Plan (mep2.00) <br />B. The applicant and/or property owner and developer shall be responsible for assuring <br />that any successor in interest who assumes responsibility for the zoning approval is <br />informed of its terms and conditions. <br />C. Conditional Use Permit approval shall lapse after one (1) year following Board of <br />Zoning Adjustments approval of the application unless a building permit has been <br />issued, coupled with diligent progress evidencing good faith intention to commence <br />the intended use; or an occupancy permit has been issued; or the approval is <br />renewed, as provided in Zoning Code Section 5.08.136.E. Pursuant to Zoning Code <br />Section 5.08.136.E. upon written request the approval may be renewed by the <br />Zoning Enforcement Official for one (1) year, with one additional (1) one-year renewal <br />allowed for a total period not to exceed two (2) years without notice or public hearing <br />if the findings required by Zoning Code Section 5.08.124.A. remain valid. Application <br />for renewal shall be made in writing to the Zoning Enforcement Official not less than <br />30 days or more than 120 days prior to expiration of the Conditional Use Permit <br />approval. Denial of a request for a renewal may be appealed. <br />II. PERMITTED USES <br />A. This is a conditional use approval to allow for office use and artists' studios at 2101 <br />Marina Boulevard. Pursuant to the Zoning Code, Offices, Business and Professional <br />is permitted per Zoning Code Section 2.08.204.A.13 and Artists' Studios is <br />conditionally permitted per Zoning Code Section 2.08.204.C.3. A use permit is <br />required for the establishment of any new land use in the S Overlay District per <br />Agreement to Conditions May 7, 2020 <br />PLN19-0064 Page 3 of 11 <br />
