RESOLUTION NO. 2024-090 1 <br />IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2024-090 <br />RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A NON- <br />PROFESSIONAL SERVICES AGREEMENT WITH GARLAND/DBS, INC. FOR ROOF RESTORATION <br />PROJECTS AT THE WATER POLLUTION CONTROL PLANT FOR FISCAL YEAR 2024-2025 FOR <br />$1,009,344 AND TO NEGOTIATE AND APPROVE CUMULATIVE CHANGE ORDERS UP TO 8% OR <br />$80,748 OF THE ORIGINAL CONTRACT AMOUNT, FOR A TOTAL NOT-TO-EXCEED AMOUNT OF <br />$1,090,092 AND TO APPROPRIATE $1,090,000 FROM THE WATER POLLUTION CONTROL <br />ENTERPRISE FUND <br />WHEREAS, the scope of services and compensation schedule for roofing repair services at the <br />History Museum and Public Works Service Center from Garland/DBS, Inc., have been presented to this <br />City Council; and <br /> <br />WHEREAS, the City Council is familiar with the contents thereof; and <br /> <br />WHEREAS, Change Orders of up to 8% to modify bid quantities or to respond to unexpected <br />conditions are a normal aspect of public contracting and construction; and <br /> <br />WHEREAS, to deliver high quality public works projects on schedule and within budget, the <br />Council finds that authorizing the approval of Change Orders is in the best interest of public health, <br />safety, and welfare; and <br /> <br />WHEREAS, the City Manager recommends the execution of said non-professional service <br />agreement. <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: <br /> <br />1. That execution of the non-professional service agreement with Garland/DBS, Inc. for the Water <br />Pollution Control Plant roofing restoration project at the price listed is approved and execution by <br />the City Manager is authorized, including up to 8% of the not to exceed amount of compensation <br />for account for change orders to the contract; and <br /> <br />2. That for Fiscal Year 2024-2025 an additional appropriation of funds be made from the Water <br />Pollution Control Fund balance in the amount of $1,090,000 to account 593-52-113. <br />
