<br />Non-Professional Services Agreement between <br />City of San Leandro and GARLAND/DBS, INC. Page 7 of 17 <br />4.2.3 Additional Requirements. Each of the following shall be included in the <br />insurance coverage or added as a certified endorsement to the policy: <br /> <br />a. The Insurance shall cover on an occurrence or an accident basis, and not <br />on a claims-made basis. <br /> <br />b. City, its officers, officials, employees, and volunteers are to be covered as <br />additional insureds as respects: liability arising out of work or operations <br />performed by or on behalf of the Contractor; or automobiles owned, <br />leased, hired, or borrowed by the Contractor. <br /> <br />c. Contractor hereby agrees to waive subrogation which any insurer or <br />contractor may require from vendor by virtue of the payment of any loss. <br />Contractor agrees to obtain any endorsements that may be necessary to <br />affect this waiver of subrogation. <br /> <br />d. For any claims related to this Agreement or the work hereunder, the <br />Contractor’s insurance coverage shall be primary insurance as respects <br />the City, its officers, officials, employees, and volunteers. Any insurance <br />or self-insurance maintained by the City, its officers, officials, employees, <br />or volunteers shall be excess of the Contractor’s insurance and shall not <br />contribute with it. <br /> <br />e. Builders’ Risk Insurance (see section 4.3, below) <br /> <br />4.2.4 Submittal Requirements. To comply with Subsection 4.2, Contractor shall <br />submit the following: <br /> <br />a. Certificate of Liability Insurance in the amounts specified in the section; <br /> <br />b. Additional Insured Endorsement as required by the section; <br /> <br />c. Waiver of Subrogation Endorsement as required by the section; and <br /> <br />d. Primary Insurance Endorsement as required by the section. <br /> <br />4.3 Builders’ Risk Insurance <br /> <br />4.3.1 General Requirements. Contractor shall cause to be taken out and maintain in the name of the <br />City and the Contractor until final completion and acceptance of the project: All Builder’s Risk Insurance, <br />including but not limited to coverage against loss or damage to the project by fire and lightening, extended <br />coverage, vandalism, malicious mischief, flood, earthquake, and collapse; said extended coverage shall <br />cover loss or damage by explosion, windstorm, riot, aircraft, vehicle damage, smoke, and other such <br />hazards as are normally covered by such coverage. Such insurance (except the earthquake and flood <br />coverage in the event that they are not fully or reasonably available) shall be in an amount equal to the <br />replacement cost (without deduction for depreciation and subject to stipulated value in lieu of average <br />clause) of all structures constituting any part of the work, excluding the cost of excavations, of grading, and <br />Docusign Envelope ID: 63402776-1199-42D7-87E8-649840160918
