<br />Non-Professional Services Agreement between May 15, 2024 <br />City of San Leandro and Kirby Tree Service —Exhibit A Page 1 of 2 <br />EXHIBIT A <br /> <br />SCOPE OF SERVICES <br /> <br />1. SUMMARY: Tree trimming services, and tree, stump and shrub removal as directed by Municipal <br />Golf Operations Advisor, or his designee. Services to include, but not limited to: <br />• Balance – give the tree an overall balanced look. <br />• Clean-up – general thinning of the tree to give it a neat and organized appearance. Includes <br />the removal of all dead branches, crisscrosses, nubs, and new sucker growth. <br /> <br />Stumps shall be removed by a "stump router" or any other manner as approved by Golf <br />Advisor, to a minimum depth of three inches (3") below finished grade. Contractor to clean <br />and haul debris as needed. <br /> <br />2. SCOPE: Furnish all labor, tools, equipment, materials, transportation, and perform all operations <br />necessary and incidental for the proper execution and completion of tree maintenance. <br /> <br />3. PROPERTY DAMAGE: The Contractor shall use special care to protect public and private <br />property. Contractor shall be held responsible for any breakage, loss of the City’s equipment or <br />supplies through negligence of the contractor or their employee while working on the City’s <br />premises. This includes damage to adjacent trees and shrubs, lawns, tables, curbs, walks, and <br />other property. The contractor shall be responsible for restoring or replacing any equipment, <br />facilities, etc. so damaged. The contractor shall immediately report to the City any damages to the <br />premises resulting from services performed under their contract. Failure or refusal to restore or <br />replace such damaged property will be a breach of their contract. <br /> <br />4. LIQUIDATED DAMAGES: Failure to start and complete all work specified within the time allowed <br />shall constitute material breach of contract. The “time allowed” will be calculated from the date of <br />the Purchase Order issuance through the Project Delivery as indicated. Failure of Contractor to <br />complete the work within the time allowed will result in damages, and for each consecutive day in <br />excess, the contractor shall pay to the City the sum of $100.00 per calendar day. Such amount <br />shall not be construed as a penalty but as a minimum value of liquidated damages that may be <br />deducted from payment due to the contractor if such delay occurs. <br /> <br />5. LICENSES: Contractor must possess current City business license, California Contractor’s License <br />and DIR Contractor Registration for duration of contract. <br /> <br />6. MOBILIZATION: Contractor shall have five (5) business days from notice by City to provide proof <br />of insurance, proof of Contractor’s license, proof of business license and such other documentation <br />as required. <br /> <br />7. PAYMENT: Payment will be made when tree maintenance is complete. <br /> <br />8.
