<br />28 <br /> <br />5.08.132 Effective Date; Appeals <br />A use permit or variance shall become effective 15 days after action by the Planning Commission, <br />unless appealed to the City Council in accord with Chapter 5.20 Appeals. <br />5.12.112 Review and Approval Authority <br />A. The Zoning Enforcement Official shall review and approve, conditionally approve, or disap- <br />prove applications for Site Plan Review based on consideration of the requirements of this chap- <br />ter except as follows. <br /> <br />1. The Planning Commission shall have Site Plan Review authority for all projects otherwise <br />requiring Planning Commission approval. <br /> <br />2. The Zoning Enforcement Official may refer items directly the Planning Commission when <br />in the Zoning Enforcement Official’s opinion, the public interest would be better served by <br />having the Planning Commission conduct Site Plan Review. <br />5.14.108 Review and Approval Authority <br />The Planning Commission shall review and approve, conditionally approve, or disapprove applica- <br />tions for development plans based on consideration of the requirements of this chapter. <br />5.14.116 Notice and Public Hearing <br />A. Public Hearing Required. The Planning Commission shall hold a public hearing on an applica- <br />tion for a development plan. <br />5.14.120 Duties of Planning Commission <br />A. Public Hearing. The Planning Commission shall conduct the public hearing, which may be con- <br />tinued from time to time, and hear testimony for and against the application. <br /> <br />B. Decision and Notice. After the close of the public hearing, the Commission shall approve, con- <br />ditionally approve, or deny the application. Notice of the decision shall be mailed to the appli- <br />cant and any other party requesting such notice within seven days of the date of the action rati- <br />fying the decision.
