<br />31 <br /> <br />5.40.132 Violations to Conditions of Approval <br />A. In the event of a violation of any of the provisions set forth in these regulations, or upon evidence <br />that there has been a failure to comply with any prescribed condition of approval, the Planning <br />Commission may hold a public hearing. Notification of the public hearing shall be in accordance <br />with Section 5.24.108 Revocation of Discretionary Permits. <br /> <br />B. The purpose of this public hearing is to receive testimony and determine whether violations to <br />any conditions of approval attached to the site have occurred. The Planning Commission may <br />add to or amend the existing conditions of approval based upon the evidence presented; or, <br />alternatively, may revoke the Deemed Approved Activity’s Deemed Approved Status and dis- <br />continue the Alcoholic Beverage Sales. The determination of the Planning Commission shall <br />become final 15 calendar days after the date of decision unless appealed to the City Council in <br />accordance with Chapter 5.20 Appeals. <br />
