Contractor shall establish a specific 704 <br />San Leandro residency code to track the volume of materials self-hauled on the public drop-off day. 705 <br />Contractor shall report the number of Customers and volume of materials collected during the annual 706 <br />drop-off event within thirty (30) days of the event. Any amount over two (2) cubic yards will require 707 <br />payment of the posted gate rate. 708 <br />ARTICLE 5. 709 <br />STANDARD OF PERFORMANCE 710 <br />5.1 GENERAL 711 <br />Contractor shall at all times comply with Applicable Law and provide services in a manner that is safe to 712 <br />the public and the Contractor’s employees. Except to the extent that a higher performance standard is 713 <br />specified in this Agreement, Contractor shall perform services in accordance with Post Collection Services 714 <br />management practices common to the San Francisco Bay Area. 715 <br />5.2 OPERATION STANDARDS 716 <br />5.2.1 Permits 717 <br />A. Securing Permits. Contractor shall obtain and maintain at Contractor’s sole cost all permits required 718 <br />under Applicable Law to perform Post-Collection Services. Contractor shall provide City proof of 719 <br />permits and shall demonstrate compliance with the terms and conditions of permits promptly upon 720 <br />request of City. In its Annual Report or more frequently, as necessary, Contractor shall inform City 721 <br />of any permit-related or regulatory concerns and Contractor’s status of securing the issuance, 722 <br />revision, modification, extension, or renewal of permits necessary to address such concerns. 723 <br />Promptly upon City direction, Contractor shall provide City with copies of permits and any 724 <br />applications or other correspondence that the Contractor submits in connection with securing 725 <br />Permits. 726 <br />B. Complying with Permits. Contractor shall at all times provide services in compliance with all 727 <br />Permits, including any mitigation measures related to the operation and maintenance of the 728 <br />Approved Facility(ies). Contractor is solely responsible for paying any fines or penalties imposed for 729 <br />noncompliance with or violation of permits or failure to obtain permits. 730 <br />5.2.2 Rejection of Unpermitted Waste 731 <br />A. Inspection. Contractor shall use standard industry practices to detect and reject Unpermitted 732 <br />Waste in a uniform and non-discriminatory manner and shall not knowingly Accept Unpermitted 733 <br />Waste at the Approved Facility(ies). Contractor shall comply with the inspection procedure 734 <br />contained in its permit requirements and in accordance with its operations plan. Contractor shall 735 <br />promptly modify that procedure to reflect any changes in permits or Applicable Law. 736 <br />Contractor shall develop a load inspection program that includes the following components: (i) 737 <br />personnel and training; (ii) load checking activities; (iii) management of Unpermitted Waste; and, 738 <br />(iv) record keeping and emergency procedures.
