EXHIBIT A <br />DEFINITIONS <br />July 15, 2024 Page A-9 Post-Collection Agreement, Exhibit A <br />or Federal law, regulation or ordinance, including land use restrictions or conditions, waste that cannot <br />be Disposed of in Class III landfills, waste that in Contractor’s reasonable opinion would present a <br />significant risk to human health or the environment, cause a nuisance, or otherwise create or expose <br />Contractor or City to potential liability; but not including de minimis volumes or concentrations of waste <br />of a type and amount normally found in Residential Solid Waste after implementation of programs for the <br />safe Collection, Recycling, treatment, and Disposal of batteries and paint in compliance with Sections <br />41500 and 41802 of the California Public Resources Code. <br />“Extended Producer Responsibility Program” means an environmental program or policy codified, <br />enforced, and/or monitored by local, State, or Federal governments in which a producer’s or retailer’s <br />administrative, financial, operational, and/or physical responsibility for a product is extended to the post- <br />consumer stage of a product’s life cycle. Extended Producer Responsibility Programs may be implemented <br />by individual producers, collective industry organizations such as a producer responsibility organization, <br />or other regulated entities specified under the program. Such programs may cover individual products or <br />categories of products, using one (1) or more funding mechanisms, as defined in the regulation <br />establishing the program. <br />“Federal” means belonging to or pertaining to the Federal government of the United States. <br />“Food Scraps” means those Discarded Materials that will decompose and/or putrefy including: (i) all <br />kitchen and table food waste; (ii) animal or vegetable waste that is generated during or results from the <br />storage, preparation, cooking, or handling of food stuffs; (iii) fruit waste, grain waste, dairy waste, meat, <br />and fish waste; and, (iv) vegetable trimmings, houseplant trimmings, flowers, and other Compostable <br />Organic Waste common to the occupancy of Residential dwellings or businesses involved in food <br />production, preparation, or sales. <br />“Food-Soiled Paper” means pre- and post-consumer Compostable Paper material that has come in <br />contact with food or liquid such as, but not limited to, Compostable Paper plates, paper coffee cups, coffee <br />filters, napkins, and pizza boxes, not to include paper products that are lined or coated with a plastic or <br />non-organic wax. Food-Soiled Paper is a subset of Food Waste. <br />“Food Waste” means Source Separated Food Scraps and Food-Soiled Paper. Food Waste is a subset of <br />Organic Materials. <br />“Generator” means any Person whose act or process produces City Delivered Materials or C&D Debris, or <br />whose act first causes City Delivered Materials or C&D Debris to become subject to regulation. <br />“Gross Receipts” means total cash receipts collected from Collection Contractor by the Contractor for the <br />provision of services pursuant to this Agreement, without any deductions. Gross Receipts do not include <br />revenues from the sale of Recyclable Materials. <br />“Gross Tipping Fees” means total billings by the Contractor for the provision of services pursuant to this <br />Agreement, without any deductions. <br />Docusign Envelope ID: C78C62DE-8589-496F-8F5A-DEC38EE5853C
