<br />“Recycle” or “Recycling” (or any variation thereof) means the process of sorting, cleansing, treating, and
<br />reconstituting, at a Recyclable Materials Processing Facility or a Secondary Processing Facility, materials
<br />that would otherwise be Disposed of at a landfill for the purpose of returning such materials to the
<br />economy in the form of raw materials for new, reused, or reconstituted products. Recycling does not
<br />include any thermal or chemical conversion methods.
<br />“Responsible End Markets” shall have the same meaning as in SB 54 as it may be amended,
<br />supplemented, superseded, and replaced from time to time.
<br />“Residential” means of, from, or pertaining to a Single-Family Premises, Multi-Plex, or Multi-Family
<br />Premises including Single-Family homes, apartments, condominiums, townhouse complexes, mobile
<br />home parks, and cooperative apartments.
<br />“Residue” or “Residual” means those materials which, after Processing, are Disposed rather than
<br />Recycled, Composted, or otherwise recovered due to either the lack of markets for materials or the
<br />inability of the Processing Facility to capture and recover the materials.
<br />“Reusable Materials” means items that are capable of being used again after minimal Processing.
<br />Reusable Materials may be Collected, Source Separated, or recovered through a Processing Facility and
<br />reuse markets developed by Contractor. Reusable Materials may include but are not limited to Textiles,
<br />furniture, and/or sporting equipment.
<br />“SB 54” means the Plastic Pollution Prevention and Packaging Producer Responsibility Act approved by
<br />the California Governor on June 30, 2022, which amended Section 41821.5 of the Public Resources Code
<br />to add Chapter 3 (commencing with Section 42040) to Part 3 of Division 30, as amended, supplemented,
<br />superseded, and replaced from time to time. For the purposes of this Agreement, SB 54 includes any
<br />implemented regulations developed by CalRecycle, as amended supplemented, superseded, and replaced
<br />from time to time.
<br />“SB 343” means the Environmental Advertising: Recycling Symbol: Recyclability: Products and Packaging
<br />Senate Bill approved by the California Governor on October 5, 2021, which amended Sections 17580,
<br />17580.5 of the Business and Professions Code, and amended Sections 18015 and 42355.5 of, and added
<br />Section 42355.51 to, the Public Resources Code, relating to environmental advertising, advertising, as
<br />amended, supplemented, superseded, and replaced from time to time. For the purposes of this
<br />Agreement, SB 343 includes any implemented regulations developed by CalRecycle, as they may be
<br />amended supplemented, superseded, and replaced from time to time.
<br />“SB 1383” means the Short-Lived Climate Pollutants Act of 2016 (an act to add Sections 39730.5, 39730.6,
<br />39730.7, and 39730.8 to the Health and Safety Code, and Chapter 13.1 (commencing with Section 42652)
<br />to Part 3 of Division 30 of the Public Resources Code, establishing methane emissions reduction targets in
<br />a statewide effort to reduce emissions of short-lived climate pollutants as amended, supplemented,
<br />superseded, and replaced from time to time.
