EXHIBIT A <br />DEFINITIONS <br />July 15, 2024 Page A-7 Franchise Agreement, Exhibit A <br />“Designated Organic Materials Processing Facility” means for Commercial Organic Materials the Organic <br />Materials Recovery Facility (OMCF) located at the Davis Street Resource Recovery Complex and Transfer <br />Station, which is owned and operated by Waste Management of Alameda County, Inc. or for Residential <br />Organic Materials the Altamont CASP, which is owned and operated by Waste Management of Alameda <br />County, Inc. . The Designated Organic Materials Processing Facility shall serve as the Processing site for all <br />Organic Materials Collected by Contractor. Subject to Section 3.5 and 4.1 of the Agreement, the City may, <br />at its sole discretion, specify a different Designated Organic Materials Processing Facility. All Organic <br />Materials Collected by Contractor shall be delivered to the Designated Organic Materials Processing <br />Facility. <br />“Designated Processing Facility(ies)” means any one of or any combination of the: Designated Organic <br />Materials Processing Facility; Designated Recyclable Materials Processing Facility; Designated C&D <br />Processing Facility; and/or, Designated Transfer Facility. <br />“Designated Recyclable Materials Processing Facility” means the Alameda County Industries Materials <br />Processing Facility in San Leandro, CA, which is owned and operated by Alameda County Industries, LLC.. <br />The Designated Recyclable Materials Processing Facility shall serve as the Processing site for all Recyclable <br />Materials Collected by Contractor. Subject to Section 3.5 and 4.1 of the Agreement, the City may, at its <br />sole discretion, specify a different Designated Recyclable Materials Processing Facility. All Recyclable <br />Materials Collected by Contractor shall be delivered to the Designated Recyclable Materials Processing <br />Facility. <br />“Designated Transfer Facility” means Alameda County Industries Transfer Station in San Leandro, CA, <br />which is owned by Alameda County Industries, LLC. <br />“Designated Waste” means non-Hazardous Waste that may pose special Disposal problems because of its <br />potential to contaminate the environment and that may be Disposed of only in Class II Disposal sites or <br />Class III Disposal sites pursuant to a variance issued by the California Department of Health Services. <br />Designated Waste consists of those substances classified as Designated Waste by the State, in CCR Title <br />23, Section 2522 as may be amended from time to time. <br />“Discarded Materials” means Recyclable Materials, Organic Materials, and Solid Waste placed by a <br />Generator in a receptacle and/or at a location for the purposes of Collection by Contractor, excluding <br />Excluded Waste , pursuant to the City’s Municipal Code. <br />“Disposal” or “Dispose” (or any variation thereof) means the final disposition of Solid Waste, or <br />Processing Residue at a Disposal Facility. <br />“Disposal Facility” means a landfill, or other facility, for ultimate Disposal of Solid Waste. <br />“Divert” or “Diversion” (or any variation thereof) means to prevent Discarded Materials, C&D Debris, or <br />Bulky Items from Disposal at landfill or transformation facilities, (including facilities using incineration, <br />pyrolysis, distillation, gasification, or biological conversion methods) through Source Reduction, reuse, <br />Recycling, Composting, anaerobic digestion, or other method of Processing, in accordance with the <br />provisions of AB 939 and SB 1383.
