<br />approved by City are the maximum Rate that Contractor may charge a Customer and Contractor may, in
<br />its sole discretion, charge any amount up to and including the maximum Rate approved by the City.
<br />“Rate Adjustment Factor” means the amount determined under Exhibit E1 or Exhibit E2, whichever
<br />applies for a particular Rate Period.
<br />“Rate Period” means a twelve (12) month period, commencing July 1 and concluding June 30.
<br />“Recyclable Materials” means those Discarded Materials that the Generators set out in Recyclable
<br />Materials Containers for Collection for the purpose of Recycling by the Contractor and that exclude
<br />Excluded Waste. No Discarded Materials shall be considered Recyclable Materials unless such material is
<br />separated from Organic Materials and Solid Waste. Recyclable Materials shall include, at a minimum,
<br />newspaper (including inserts, coupons, and store advertisements); mixed paper (including office paper,
<br />computer paper, magazines, junk mail, catalogs, brown paper bags, brown paper, paperboard, paper egg
<br />cartons, phone books, grocery bags, colored paper, construction paper, envelopes, legal pad backings,
<br />shoe boxes, and cereal and other similar food boxes); chipboard; corrugated Cardboard; paper milk
<br />cartons; glass bottles and jars (including brown, clear, and green glass bottles and jars); aluminum
<br />(including beverage containers, foil, food containers, small pieces of scrap metal); small pieces of scrap
<br />metal weighing less than ten (10) pounds and fitting into the Recyclable Materials Collection Container;
<br />steel, tin, or bi-metal cans; plastic containers (no. 1 to 7); and, aseptic beverage boxes. In addition,
<br />Recyclable Materials Collected from Residential Premises shall include empty steel paint cans (formerly
<br />used for latex paint) and aerosol cans. The Parties agree that this list will be reviewed as part of the Cost-
<br />Based Rate Adjustment process described in Exhibit E2, and that during such review materials may be
<br />added to or subtracted from this list by mutual consent. Contractor shall not add or subtract materials to
<br />or from this list without approval from the City Contract Manager, and such approval shall not be
<br />unreasonably withheld.
<br />“Recycle” or “Recycling” (or any variation thereof) means the process of sorting, cleansing, treating, and
<br />reconstituting, at a Recyclable Materials Processing Facility, materials that would otherwise be Disposed
<br />of at a landfill for the purpose of returning such materials to the economy in the form of raw materials for
<br />new, reused, or reconstituted products.
<br />“Residential” shall mean of, from, or pertaining to a Single-Family Premises, or Multi-Family Premises
<br />including Single-Family homes, apartments, condominiums, townhouse complexes, mobile home parks,
<br />and cooperative apartments.
<br />“Residue” or “Residual” means those materials which, after Processing, are Disposed rather than
<br />Recycled, Composted, or otherwise recovered due to either the lack of markets for materials or the
<br />inability of the Processing Facility to capture and recover the materials.
<br />“Reusable Materials” means items that are capable of being used again after minimal Processing.
<br />Reusable Materials may be Collected, Source Separated, or recovered through a Processing Facility and
<br />reuse markets developed by Contractor. Reusable Materials may include but are not limited to Textiles,
<br />furniture, and/or sporting equipment.
