Contractor shall not 498 <br />change the Residue level calculation method without prior, written approval from the City. 499 <br />Residue from the Contractor’s Processing of Recyclable Materials shall be Transported and Disposed 500 <br />of by Contractor at Contractor’s sole expense. Contractor shall be fully responsible for the safe 501 <br />Disposal of all such Residue in accordance with Applicable Law. Residue delivered for Disposal shall 502 <br />not include any Excluded Materials. 503 <br />E. Marketed Commodities. Contractor shall market Diverted Materials in the Commodity categories 504 <br />and grades listed in this Section. If the Contractor wants to modify the Commodity categories or 505 <br />grades during the Term of the Agreement, the Contractor shall request approval from City, and such 506 <br />approval shall be obtained before changes are implemented. Commodity categories and grades 507 <br />shall include, at minimum: 508 <br />1. Fiber 509 <br /> Old corrugated Cardboard (OCC) 510 <br /> Mixed paper (MP) 511 <br />2. Metals 512 <br /> Aluminum 513 <br /> Tin 514 <br />3. Plastics 515 <br /> PET 516 <br /> HDPE Natural 517 <br /> HDPE Color 518 <br /> Mixed rigid plastics 519 <br />4. Mixed Glass Containers 520 <br />F. Changes to Accepted Materials. Contractor shall Accept all Recyclable Materials as defined in 521 <br />Exhibit C and shall Accept all materials required to be Accepted and/or Recycled by Applicable Law 522 <br />or Extended Producer Responsibility Programs, including but not limited to, AB 1201, SB 1383, SB 523 <br />54, and SB 343, unless otherwise directed by the City. A change in the Acceptable materials list 524 <br />resulting from a Change in Law shall not warrant an adjustment to the Contractor’s compensation, 525 <br />except as otherwise provided for in Section 8.4.D or Section 8.4.E. 526 <br />If either Party is made aware of a required change in the Accepted materials list due to an Extended 527 <br />Producer Responsibility Program or Applicable Law, that Party shall notify the other Party within 528 <br />five (5) calendar days of being made aware of such change. Upon City request, the Parties shall 529 <br />promptly meet and confer to discuss the timeline and process for implementing such changes to 530 <br />the Acceptable materials list. If the change in the Accepted material list is due to an Extended 531 <br />Producer Responsibility Program, Contractor shall implement such changes in accordance with, and 532 <br />subject to the limitations of, Section 3.7. Contractor shall implement changes to the Accepted 533 <br />materials list within thirty (30) days after approval by the City or by any required deadlines under 534 <br />Applicable Law, whichever is sooner.
