<br />July 2024 Page 22 City of San Leandro Post Collection <br />5.2.6 Traffic Control and Direction 829 <br />Contractor and its Subcontractors shall construct and maintain all roads required to Transport City 830 <br />Delivered Materials from the Approved Facility(ies) site entrance to scale house and to the actual point of 831 <br />unloading at the Transfer, Processing, or Disposal area of the Approved Facility(ies). Contractor and its 832 <br />Subcontractors shall direct on-site traffic to appropriate unloading areas and provide a safe working 833 <br />environment for Approved Facility(ies) users, visitors, and employees. Contractor and its Subcontractors 834 <br />shall provide necessary roadways, signs, and personnel to assist drivers to proper unloading areas. 835 <br />Contractor shall maintain all roadways and signs at the Approved Facility(ies) in a clean and usable 836 <br />condition. The Contractor and its Subcontractors shall provide and maintain roadways and signs for the 837 <br />convenience of vehicles using the Approved Facility(ies) and to facilitate safe and efficient traffic flow at 838 <br />the Approved Facility(ies). 839 <br />5.2.7 Vehicle Turnaround Times 840 <br />A. General. Contractor and its Subcontractors shall each maintain a maximum vehicle turnaround time 841 <br />of twenty (20) minutes for Collection Contractor delivery of City Delivered Materials to the 842 <br />Approved Facility(ies). Failure to meet this guaranty for more than five (5) consecutive Working Days 843 <br />or more than ten (10) Working Days in any sixty (60) day period, equates to default of Contractor’s 844 <br />performance obligations under this Agreement. Contractor and its Subcontractors shall have a ten 845 <br />(10) Business Day period to cure this breach before Liquidated Damages are assessed in accordance 846 <br />with this Section and Section 10.6. 847 <br />B. Guaranteed Collection Vehicle Turnaround Time. Contractor and its Subcontractors shall operate 848 <br />the Approved Facility(ies) so that all Collection Contractor vehicles are processed, unloaded, and 849 <br />exited from the Approved Facility(ies) property in a timely manner such that the maximum 850 <br />turnaround time is no more than twenty (20) minutes per Collection Contractor vehicle. The vehicle 851 <br />turnaround time shall be the elapsed time from the vehicle entering the Approved Facility(ies) 852 <br />property to the vehicle leaving the Approved Facility(ies) property. 853 <br />C. Supporting Documentation. Upon City request, Contractor and its Subcontractors shall provide the 854 <br />City reports or access to electronic scale house system records and/or on-site camera recording that 855 <br />provide the City information to determine actual vehicle turnaround times. Contractor and its 856 <br />Subcontractors acknowledge that the City may conduct on-site surveys to verify compliance with 857 <br />the guaranteed vehicle turnaround times for Collection Contractor’s vehicles. The Contractor and 858 <br />its Subcontractors acknowledge that the City may also use GPS (global positioning system) records 859 <br />provided by Collection Contractor for Collection Contractor’s vehicles to calculate actual vehicle 860 <br />turnaround times. At Contractor or its Subcontractor’s option, Contractor or such Subcontractor 861 <br />may, at its own cost, implement and maintain a technology-based vehicle tracking system of 862 <br />recording inbound and outbound Collection Contractor’s vehicle times (such as a system that uses 863 <br />RFID vehicle tags and RFID readers). Such system shall not inconvenience the Collection Contractor 864 <br />or City or delay Collection Contractor’s vehicles from arriving and departing the Approved 865 <br />Facility(ies). 866 <br />D. Complaint Resolution. Contractor shall respond within five (5) Business Days to any written 867 <br />Complaint received from the City or Collection Contractor related to vehicle turnaround times. 868 <br />Contractor shall work directly with the Collection Contractor to identify and resolve issues that are 869 <br />causing vehicle turnaround times to extend beyond the maximum vehicle turnaround time stated 870 <br />in subsection B.
