<br />July 2024 Page 1 City of San Leandro Post Collection <br />AGREEMENT 1 <br />BETWEEN 2 <br />CITY OF SAN LEANDRO 3 <br />AND 4 <br />ALAMEDA COUNTY INDUSTRIES, INC. 5 <br />FOR RECYCLABLES PROCESSING AND TRANSFER AND 6 <br />TRANSPORT POST-COLLECTION SERVICES 7 <br />THIS AGREEMENT is made and entered into as of ___________________, 2024 between the City of San 8 <br />Leandro, California, a political subdivision of the State of California (hereinafter “City”), and Alameda 9 <br />County Industries, Inc., (hereinafter referred to as the “Contractor”). 10 <br />RECITALS 11 <br />This Agreement is entered into with reference to the following facts and circumstances: 12 <br />WHEREAS, the Legislature of the State of California, by enactment of the California Integrated Waste 13 <br />Management Act of 1989 (AB 939) (California Public Resources Code Section 40000 et seq.), has declared 14 <br />that it is in the public interest to authorize and require local agencies to make adequate provisions for 15 <br />Solid Waste services within their jurisdiction; and 16 <br />WHEREAS, the State of California has found and declared that the amount of refuse generated in 17 <br />California, coupled with diminishing Disposal capacity and potential adverse environmental impacts from 18 <br />landfilling and the need to conserve natural resources, have created an urgent need for State and local 19 <br />agencies to enact and implement an aggressive integrated waste management program. The State has, 20 <br />through enactment of AB 939 and subsequent related legislation including, but not limited to: the Jobs 21 <br />and Recycling Act of 2011 (AB 341), the Event and Venue Recycling Act of 2004 (AB 2176), SB 1016 22 <br />(Chapter 343, Statutes of 2008 [Wiggins, SB 1016]), the Mandatory Commercial Organics Recycling Act of 23 <br />2014 (AB 1826), and the Short-Lived Climate Pollutants Bill of 2016 (SB 1383), the California Green Building 24 <br />Standards Code (CALGreen), AB 1594, AB 1201, AB 343, and the Plastic Pollution Prevention and Packaging 25 <br />Producer Responsibility Act (SB 54), directed the responsible State agency, and all local agencies, to 26 <br />promote Diversion and to maximize the use of feasible waste reduction, re-use, Recycling, and 27 <br />Composting options in order to reduce the amount of refuse that must be Disposed; and 28 <br />WHEREAS, SB 1383 establishes regulatory requirements for jurisdictions, Generators, haulers, Solid Waste 29 <br />facilities, and other entities to support achievement of State-wide Organic Waste Disposal reduction 30 <br />targets; and 31 <br />WHEREAS, in response to the Governor signing Executive Order N-79-20, the California Air Resources 32 <br />Board has established regulations, including, but not limited, the Advanced Clean Fleets Rule, as part of a 33 <br />strategy to transition fleets to zero emissions vehicles (ZEVs), and provisions of such regulations apply to 34 <br />the Contractor’s vehicle fleet under this Agreement; and, 35 <br />Docusign Envelope ID: DD1D0F3A-E7BC-4C69-8F25-5A59BD356B1B <br />August 14, 2024 | 9:16:31 AM PDT
