<br /> <br />Non-Professional Services Agreement between August 8, 2024 <br />City of San Leandro and Garland/DBS Inc.—Exhibit F Page 1 of 22 <br />EHIBIT F <br /> <br />COMMUNITY WORKFORCE AGREEMENT <br /> <br />For the City of San Leandro <br /> <br /> <br />This Agreement is made and entered into this ______ day of , by and <br />between the City of San Leandro ("City") together with contractors and sub-contractors of all tiers, who <br />shall become parties to this Agreement by signing the "Agreement to be Bound" (Attachment A), and <br />the Alameda County Building & Construction Trades Council and its affiliated local Unions who have <br />executed this Agreement. <br /> <br />PURPOSE <br /> <br />The purpose of this Agreement is to support the efforts of the City to increase employment <br />opportunities for workers who reside in San Leandro, to help increase training and employment <br />opportunities for the City's students in the construction trades through apprenticeship and pre-apprentice <br />programs as the students graduate from the City's schools, to promote efficiency of construction <br />operations performed for and within the City of San Leandro and to provide for peaceful settlement <br />of labor disputes and grievances without strikes or lockouts, thereby promoting the public interest in <br />assuring the timely and economical completion of the projects. <br /> <br />RECITALS <br /> <br />WHEREAS, the successful completion of the City's construction projects is of the utmost <br />importance to the City of San Leandro; and <br />WHEREAS, the interests of the general public, the City, the Unions and Contractor(s) would be <br />best served if the construction work proceeded in an orderly manner without disruption because of strikes, <br />sympathy strikes, work stoppages, picketing, lockouts, slowdowns or other interferences with work; and <br />WHEREAS, the Contractor(s) and the Unions desire to mutually establish and stabilize wages, <br />hours and working conditions for the workers employed on construction work for and within the City of <br />San Leandro by the Contractor(s), and further, to encourage close cooperation among the Contractor(s) <br />and the Union(s) to the end that a satisfactory, continuous and harmonious relationship will exist among <br />the parties to this Agreement; and <br />WHEREAS, the parties agree that one of the primary purposes of this Agreement is to avoid the <br />tensions that might arise on the Project if Union and non-union workers of different employers were to <br />work side by side on the Project, thereby leading to labor disputes that could delay completion of the <br />Project; and <br />WHEREAS, this Agreement is not intended to replace, interfere with, abrogate, diminish or modify <br />existing local or national collective bargaining agreements in effect during the duration of the Project, <br />insofar as a legally binding agreement exists between the Contractor(s)/Employer(s) and the affected <br />Union(s), except to the extent that the provisions of this Agreement are inconsistent with said collective <br />bargaining agreements, in which event, the provisions of this Agreement shall prevail; and <br />Docusign Envelope ID: 23D71AEE-659C-4B6B-8D08-6EB3E43824A2
