Amendment No. 2 to Consulting Services Agreement between City of San Leandro and 7/23/2024 Rincon Consultants, Inc. for Housing Element Update and EIR Page 1 of 2 AMENDMENT NO. 2 TO CONSULTING SERVICES AGREEMENT BETWEEN THE CITY OF SAN LEANDRO AND RINCON CONSULTANTS, INC. TO PREPARE THE 2023-2031 (SIXTH CYCLE) HOUSING ELEMENT UPDATE, RELATED GENERAL PLAN AND ZONING CODE AMENDMENTS, AND ASSOCIATED ENVIRONMENTAL IMPACT REPORT This Amendment No. 2 (“Amendment”) is made by and between the City of San Leandro (“City”) and Rincon Consultants, Inc. (“Consultant”) (together sometimes referred to as the “Parties”) as of July 23, 2024, and amends that certain Consulting Services Agreement (“Agreement”) dated July 20, 2021, and Amendment No. 1 dated October 4, 2022, between the Parties. WHEREAS, City and Consultant have executed the Agreement, pursuant to which Consultant has provided certain consulting services to City with regard to prepare the 2023-2031 (Sixth Cycle) Housing Element Update, Related General Plan and Zoning Code Amendments, and Associated Environmental Impact Report, and WHEREAS, the Parties desire to amend the Agreement to extend the term of the agreement; NOW THEREFORE, for good and valuable consideration, the sufficiency of which is hereby acknowledged, the Parties hereby agree to amend the Agreement as follows: 1. Section 1.1 of the Agreement entitled “Term of Services” is hereby amended to extend the term from January 1, 2024, to June 30, 2025; 2. All other terms shall remain in full force and effect. This Amendment may be executed in multiple counterparts, each of which shall be an original and all of which together shall constitute one agreement.
