IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2024-119 RESOLUTION TO APPROVE AND AUTHORIZE THE CITY MANAGER TO EXECUTE A SOLE SOURCE PROCUREMENT, AND EXECUTE A 5 YEAR RENEWAL CONTRACT WITH AXON ENTERPRISE, INC. FOR THE AXON OFFICER SAFETY PLAN 10 PREMIUM; AND TO AUTHORIZE CONTINUED SUBSCRIPTION SERVICE TO A DIGITAL EVIDENCE MANAGEMENT SYSTEM FOR A NOT TO EXCEED AMOUNT OF $1,982,962.35; TO AUTHORIZE ADDITIONAL CUMULATIVE AGREEMENT AMENDMENTS UP TO 10% ($198,296.25); AND TO REAPPROPRIATE $130,859.56 FROM FISCAL YEAR 2023-2024 SALARY SAVINGS TO FISCAL YEAR 2024-2025 TO ACCOUNT 010-21-002-5311 WHEREAS, the San Leandro City Council approved Resolution No. 2019-096 to renew a 5 year contract with Axon Enterprise, Inc. (Formerly Taser International) for 110 Police Department Body Worn Cameras, 110 TASER Devices, and Continued Subscription Service to a Digital Evidence Management System; and WHEREAS, a new 5 year contract between the City of San Leandro and Axon Enterprise, Inc. was presented to this City Council; and WHEREAS, the contract upgrades existing hardware and outfits a total of 100 field personnel with body worn cameras, TASER-10 conducted electrical devices, 5 Axon Air licenses, Virtual Reality Training, My90 Survey Tool, redaction and transcription software, while also expanding the Police Department’s subscription service to Axon’s Digital Evidence Management System by including unlimited storage for not only Axon digital files, but also unlimited 3rd party digital file storage; and WHEREAS, the Police Department fully implemented policies and will train staff on the updated hardware prior to deployment; and WHEREAS, a sole source procurement is justified under California Public Contract Code section 3400 for Axon Enterprise, Incorporated because the hardware and services provided by the vendor must align with current training standards for less-lethal use of force and match existing deployed equipment of Police Department field personnel; and WHEREAS, the City Council is familiar with the contents thereof; and WHEREAS, the City Manager recommends approval of said agreement. NOW, THEREFORE, the City of San Leandro City Council does RESOLVE as follows: 1. That in accordance with California Public Contract Code §3400 and the applicable Recitals above, the City Council makes a sole source justification to procure all equipment, licensing, and services from Axon Enterprise, Incorporated; and 2. That said contract in the amount not to exceed $1,982,962.35 over a 5-year period is hereby approved and execution by the City Manager is hereby authorized; and
