IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br />RESOLUTION NO. 2025-001 <br />RESOLUTION TO APPROVE A COOPERATIVE IMPLEMENTATION AGREEMENT WITH THE <br />CALIFORNIA DEPARTMENT OF TRANSPORTATION FOR CONSTRUCTION OF TWO <br />STORM WATER TRASH CAPTURE DEVICES; APPROPRIATE $3,300,000 FROM GENERAL FUNDS <br />TO BE REIMBURSED; AND AUTHORIZE THE CITY MANAGER TO ACCEPT AND EXECUTE ALL <br />DOCUMENTS RELATED TO THE GRANT FUNDS FOR THE TRASH CAPTURE DEVICES, <br />PROJECT NO. 2017.0540 <br /> <br />WHEREAS, the State of California Department of Transportation (CalTrans) has provided funds <br />for the program shown above; and <br /> <br />WHEREAS, procedures established by CalTrans require a resolution certifying the approval by <br />the grantee’s governing board either before submission of said application(s) to the State or prior to <br />execution of the grant agreement; and <br /> <br />WHEREAS, the Applicant/Grantee, if selected, will enter into an agreement with the State of <br />California to carry out the project; and <br /> <br />WHEREAS, the City of San Leandro proposes to implement the related trash capture device <br />installation; and <br />WHEREAS, the project will address storm water trash load reduction as well as incorporate a <br />gross solid screening device to capture trash and debris from related drainage areas of CalTrans Right <br />of Way; and <br />WHEREAS, the CalTrans owns property within the City and storm water from such property will <br />flow into the project; and <br />WHEREAS, CalTrans and the City, pursuant to California Streets and Highways Code (SHC) <br />Sections 114 and 130, will enter into a Cooperative Agreement for improvements to the State Highway <br />System (SHS) as a watershed stakeholder within the City’s jurisdiction; and <br />WHEREAS, CalTrans has agreed to contribute an amount not to exceed $3,300,000 dollars to the <br />City to construct the project, within the regional area under the jurisdiction of the City to comply with the <br />Total Maximum Daily Load (TMDL). <br /> NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: <br /> <br />That the City Council accepts the grant funds, action by the City Manager is approved, and <br />execution is authorized to accept $3,300,000 in State funds on the condition that the City enter into a <br />Cooperative Implementation Agreement with CalTrans to receive grant funds from CalTrans to construct <br />Trash Capture Devices as follows: <br />
