IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO RESOLUTION NO. 2025-001 RESOLUTION TO APPROVE A COOPERATIVE IMPLEMENTATION AGREEMENT WITH THE CALIFORNIA DEPARTMENT OF TRANSPORTATION FOR CONSTRUCTION OF TWO STORM WATER TRASH CAPTURE DEVICES; APPROPRIATE $3,300,000 FROM GENERAL FUNDS TO BE REIMBURSED; AND AUTHORIZE THE CITY MANAGER TO ACCEPT AND EXECUTE ALL DOCUMENTS RELATED TO THE GRANT FUNDS FOR THE TRASH CAPTURE DEVICES, PROJECT NO. 2017.0540 WHEREAS, the State of California Department of Transportation (CalTrans) has provided funds for the program shown above; and WHEREAS, procedures established by CalTrans require a resolution certifying the approval by the grantee’s governing board either before submission of said application(s) to the State or prior to execution of the grant agreement; and WHEREAS, the Applicant/Grantee, if selected, will enter into an agreement with the State of California to carry out the project; and WHEREAS, the City of San Leandro proposes to implement the related trash capture device installation; and WHEREAS, the project will address storm water trash load reduction as well as incorporate a gross solid screening device to capture trash and debris from related drainage areas of CalTrans Right of Way; and WHEREAS, the CalTrans owns property within the City and storm water from such property will flow into the project; and WHEREAS, CalTrans and the City, pursuant to California Streets and Highways Code (SHC) Sections 114 and 130, will enter into a Cooperative Agreement for improvements to the State Highway System (SHS) as a watershed stakeholder within the City’s jurisdiction; and WHEREAS, CalTrans has agreed to contribute an amount not to exceed $3,300,000 dollars to the City to construct the project, within the regional area under the jurisdiction of the City to comply with the Total Maximum Daily Load (TMDL). NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: That the City Council accepts the grant funds, action by the City Manager is approved, and execution is authorized to accept $3,300,000 in State funds on the condition that the City enter into a Cooperative Implementation Agreement with CalTrans to receive grant funds from CalTrans to construct Trash Capture Devices as follows:
