IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2025-009 <br /> <br />AMENDING TITLE 6, CHAPTER 4 OF THE SAN LEANDRO ADMINISTRATIVE CODE <br />TO ADD A PARKING CITATION FINE FOR A NEW CALIFORNIA VEHICLE CODE VIOLATION <br /> <br />WHEREAS, the Master Fee Schedule compiles City Council-approved fees for specific City <br />services provided to individuals in the community; and <br /> <br />WHEREAS, agencies are allowed to set fees at rates providing fair and reasonable recovery of <br />costs incurred in providing the services, minimizing, or eliminating use of general tax revenues; and <br /> <br />WHEREAS, Assembly Bill 413, more commonly known as the “Daylighting Law,” takes effect <br />across California in 2025. It bans vehicle parking within 20 feet of the vehicle approach side of a <br />crosswalk to make intersections safer for pedestrians. The law applies whether the crosswalk is marked <br />or unmarked and regardless of if the curb is painted red. The parking ban is reduced to 15 feet of any <br />crosswalk with a curb extension; and <br /> <br />WHEREAS, a new parking citation fine of $63.00 is proposed for violations of California Vehicle <br />Code Section 22500(n), the Daylighting Law; and <br /> <br />WHEREAS, the proposed adjustment to the Master Fee schedule has been presented to the <br />City Council; and <br /> <br />WHEREAS, the City Council is familiar with the contents thereof. <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: <br /> <br />That Title 6, Chapter 4, Section 6.4.100 of the San Leandro Administrative Code is hereby <br />amended to add a parking citation fine of $63.00 for “Parking within 20 feet of a marked or unmarked <br />crosswalk,” in violation of California Vehicle Code Section 22500(n); and <br /> <br />That the amendment shall be effective March 1, 2025. <br /> <br />Introduced by Councilmember Azevedo and passed and adopted this 21st day of January 2025 by <br />the following vote: <br /> <br />AYES: Councilmembers Aguilar, Azevedo, Boldt, Bowen, Simon, Viveros-Walton, Mayor González (7) <br /> <br />NOES: None (0) <br /> <br />ABSENT: None (0) <br /> <br /> <br />ATTEST: <br /> Kelly B.
