Page 4 of 4 <br />considered a waiver of, or an estoppel against, the later exercise of such <br />remedy or right. <br />7.6 Assignment. City may unconditionally assign this Agreement. City may <br />notify, but has no obligation to notify, Property Owner of any assignment, <br />including the name and address of the assignee. City and assignee shall be <br />jointly and severally liable for all City obligations under this Agreement. <br />7.7 Binding Effect. This Agreement shall be binding upon and inure to the <br />benefit of the successors in interest and assigns of each of the Parties <br />hereto. <br />7.8 Captions; Interpretation. The section headings used herein are solely for <br />convenience and shall not be used to interpret this Agreement. The Parties <br />acknowledge that this Agreement is the product of negotiation and <br />compromise on the part of both Parties, and the Parties agree, that since <br />the Parties have participated in the negotiation and drafting of this <br />Agreement, this Agreement shall not be construed as if prepared by one of <br />the Parties, but rather according to its fair meaning as a whole, as if all <br />Parties had prepared it. <br />7.9 Counterparts.
