IN THE CITY COUNCIL OF THE CITY OF SAN LEANDRO <br /> <br />RESOLUTION NO. 2025-041 <br /> <br />RESOLUTION TO APPROVE AMENDMENT TO TITLE 6, CHAPTER 4 OF THE SAN LEANDRO <br />ADMINISTRATIVE CODE AMENDING FEES AND CHARGES FOR WASTEWATER DISCHARGE FOR <br />FISCAL YEARS 2025-2026 THROUGH 2029-2030 <br /> <br />WHEREAS, the Water Pollution Control Enterprise Fund has rate setting objectives to <br />adequately fund sewer utility operations, maintenance, capital replacement expenditures, and debt <br />service obligations, while keeping rates as competitive as possible and maintaining a prudent level of <br />reserves; and <br /> <br />WHEREAS, the City of San Leandro conducted a Wastewater Rate Study to ensure equitable <br />allocation among customer classifications and project the fiscal sustainability of the wastewater utility; and <br /> <br />WHEREAS, this Wastewater Rate Study concluded that wastewater utility rates need to be <br />increased to adequately fund operations, maintenance, capital replacement expenditures, and debt <br />service operations; and <br /> <br />WHEREAS, all property owners within the City’s sewer service area were sent notification of <br />proposed rates on March 17, 2025 in accordance with Proposition 218; and <br /> <br />WHEREAS, from the 14,589 notices mailed to property owners, a total of 122 valid written <br />protests were received prior to the closing of the public hearing, representing fewer than the 7,294 <br />protests required for a majority protest; and <br /> <br />WHEREAS, proposed adjustments to the Master Fee Schedule are presented to the City <br />Council; and <br /> <br />WHEREAS, the City Council is familiar with the contents thereof. <br /> <br />NOW, THEREFORE, the City Council of the City of San Leandro does RESOLVE as follows: <br /> <br />1. That following public notice and public hearing as required by law, Title 6, Chapter 4, <br />Section 6.4.110 of the San Leandro Administrative Code (“Fee Schedule”) is hereby <br />amended by the attachment hereto, which is made a part hereof as Exhibit A; and <br /> <br />2. That the Fee Schedule section entitled “Wastewater Discharge Fees” is made a part of this <br />resolution and is enacted thereby; and <br /> <br />3. That the provisions of the amended Fee Schedule identified herein as the attachment <br />hereto shall take effect on July 1, 2025, and shall be automatically effective without further <br />legislative action each subsequent July 1st until July 1, 2029. <br /> <br />
