Terms and Conditions I. PERFORMANCE Julian Tree Care Inc. shall perform the work described on the preceding page (the “Work”) ina professional manner by qualified personnel using appropriate tools, equipment andtechniques to complete the job properly and safely. As a client is your responsibility to advice your neighbors for any trespass, parking space orany work done in there area or property to avoid and conflict or demands. II. TIMING Julian Tree Care Inc. staff shall use reasonable efforts to meet all performance dates, but shall not be liable for delays due to inclementweather or other causes beyond their control. An estimate of the number of days to complete the work and an expected start date are providedas a courtesy only. III. OWNERSHIP & PERMITTING Customer hereby grants Julian Tree Care Inc. a license to access and use such trees, plant materials and property in order to perform the work.Customers shall be responsible for securing any permits or authorizations required to perform the work and shall provide copies of the same toJulian Tree Care Inc.. IV. CONTRACT PRICE The contract price shall be as set out on the preceding page. Any prices specified are valid for to 3 months from the date of theestimate. If Julian Tree Care Inc. is required to perform work in circumstances other than those expressly or reasonably assumed andnormally pertaining to work of a similar nature, including any site conditions that were not known to Julian Tree Care Inc. at the time thequotation was provided, or if there is a change in the scope, timing or complexity of the work, Julian Tree Care Inc. shall promptly notify Ownerand the parties shall agree on an equitable adjustment to the contract price. V. TERMS OF PAYMENT All deposits are not refundable. The invoice is due upon receipt and interest will begin to accrue on any unpaid balance is due when job isdone. After the invoice date, a rate increase of 2% per month. Payment of any amount shall not be construed as acceptance bycustomer of defective work, and customer agrees not to withhold any amount invoiced in accordance with this contract for any reasonwhatsoever. Failure by Customer to pay any amount within 2 days after the invoice date shall constitute a breach of this contract, and inaddition to paying Julian Tree Care Inc. all amounts due hereunder. We accept all type of payments for CHECK written to: Julian Tree Care Inc.,all debit/credit cards are accepted with a 4% convenience fee. Except Commercials, HOA, etc.. VI. TERMINATION This contract may be cancelled by customer by email or a phone call to Julian Tree Care Inc. no later than 10 days before work is scheduledto commence. DEPOSIT IS NOT REFUNDABLE. VII. MINOR DAMAGES Julian Tree Care Inc. will always use reasonable care in the performance of the work however Julian Tree Care Inc. will not be liable for damagesto underground fixtures when doing stump grinding and the customer requests to stump grind lower than 6 inches below ground level.. It is theclient's responsibility to obtain mapping for underground infrastructure . If for any reason the Customer is not 100% satisfied with the work,they have 1 business day after completion to raise their concerns. No complaints will be accepted after that.VIIl. CRANE DAMAGESJulian Tree Care Inc. will always be the most careful possible to performed the work safely. When it comes to performed a crane work in clientsproperty. It could be extremely heavy and may cause damages to your pavement, driveway etc. Julian Tree Care performed work 100%satisfactory. Any damages done by crane will be clients responsibility to fix there own damages. Julian Tree Care have inform client in contractthat have been sign. IX INSURANCE AND LIABILITY Julian Tree Care Inc. is licensed, bonded, and insured therefore if anything Julian Tree Care is insured for liability resulting from injury toperson(s) or property and all employees are covered by Workers’ Compensation as required by law. Certificates of coverage are available uponrequest. X. MISCELLANEOUS This contract contains the entire understanding of Julian Tree Care Inc. and Customer with respect to the Work and reflects the prioragreements and commitments with respect thereto. There are no other oral understandings, terms or conditions and neither Party has reliedupon any representation, express or implied, not contained in this contract. This contract may only be amended by a written amendingagreement signed by both Julian Tree Care Inc. and the Customer.
